The clock is ticking: Coal-fired power plants struggle to meet emissions standards, reveals Annual Implementation Report

The Energy Community Secretariat’s Annual Implementation Report published today shows that all Contracting Parties which have coal in their energy mix are not in compliance with the emission ceilings established under their National Emission Reduction Plans (NERPs) for at least one of the three pollutants (nitrogen oxides, sulphur dioxide and dust) of the Large Combustion Plants Directive. Kosovo* failed to comply with the ceilings for all three, while Bosnia and Herzegovina and North Macedonia both failed to reach the ceilings for sulphur dioxide and dust. Ukraine’s 67 plants falling under the NERP narrowly met the emission ceilings this year, while Moldova failed to report its annual emissions of 2018. Given the lack of adoption of the NERP in Serbia, large combustion plants have to comply with the emission limit values of the Directive on an individual basis. For the majority of Serbia’s plants, this is not yet the case with emissions of sulphur dioxide being particularly worrisome.

Energy Performance Certification Tool for Georgia

On 14 November, the Energy Community Secretariat held expert consultations with Georgian stakeholders in Tbilisi, aimed at developing the skills and competencies needed to use an excel based tool for the calculation of energy performance of buildings. The tool was developed under the framework of the EU4Energy Governance project.

North Macedonia prepares first strategy in line with integrated national energy and climate plans

on 12 November 2019

On 11 November 2019, North Macedonia presented to the Secretariat the final draft of its Energy Strategy 2040, including with the perspective till 2030, which is the first to follow the overall structure of national energy and climate plans (NECPs) in the Energy Community and the timeframe indicated by the related Ministerial Council Recommendation. It covers the five dimensions of the Energy Union, although merging integration and security of energy markets and including an additional dimension on legal and regulatory aspects. The strategy sets out three scenarios, of which the intensive renewables one (green scenario) proved to be the most cost-effective. It incorporates also results from the study on 2030 targets, which the Secretariat launched in 2018 and was finalised earlier this year.

EU4Energy steers implementation of smart metering in Ukraine

on 7 November 2019

On 7 November, the first stakeholder meeting to launch support for the development of a methodology for smart meter rollout in Ukraine took place under the framework of the EU4Energy project. Smart meters measure the exact use of energy (i.e. gas and electricity) by consumers and send the information automatically to the energy supplier, giving the possibility to better manage energy use, save money and reduce emissions.

Energy Community VAT project group embarks on harmonizing taxes on cross-border energy sector transactions

Differences in value added tax (VAT) are a critical barrier to cross-border trade in electricity and gas. This is the reason why the Energy Community Secretariat with the assistance of DG TAXUD, European Commission, initiated efforts to synchronise VAT regimes across the Contracting Parties. The basis for this work is the EU VAT Directive. Its full implementation is also a precondition for market coupling, starting with the first projects between Bulgaria and North Macedonia and 4 MMC with Serbia.  A platform of VAT experts, primarily consisting of representatives of Ministries of Finance, was created to lead this process.

Latest Pan-European market monitoring report highlights new gas and electricity trends in the Energy Community

The Annual Report on the Results of Monitoring the Internal Electricity and Natural Gas Markets was released today by the EU Agency for the Cooperation of Energy Regulators (ACER) and the Council of European Energy Regulators (CEER). For the third time in a row, the report covers electricity and gas market trends in the Energy Community Contracting Parties based on data provided by the Contracting Parties’ national regulatory authorities.

EU4ENERGY meeting maps out how to improve settlement of cross-border unintentional deviations between Ukraine and Moldova

On 29 October, Energy Community Secretariat experts led a workshop in Kyiv, addressing the key mechanisms for future management of unintentional deviations between power systems of Ukraine and Moldova. Representatives of the national regulatory authorities and transmission system operators from Moldova and Ukraine engaged in an active discussion on the regulatory requirements for the settlement of the unintended exchanges in line with current practice in EU Member States and discussed approaches in designing the arrangements for settlement of unintentional deviations between power systems. Furthermore, the model of the new ENTSO-E methodology for Continental Europe on the common settlement rules for all unintended exchanges of energy was presented.

Secretariat concerned about draft amendments to the Electricity Market Law in Ukraine

A recent draft promoted by members of the Verkhovna Rada, the Parliament of Ukraine, envisages that in the future the government may prohibit or restrict electricity exports and imports, and imposes strict price caps on the wholesale market. It also excludes large renewable power installations above a capacity of 150 MW from priority dispatch, and allows for curtailment without compensation for these installations. The proposed changes are likely to breach Energy Community rules. The draft passed already the Rada’s committee on energy on Friday last week.

Energy Community Oil Forum highlights new trends and challenges in the oil sector

The 11th Energy Community Oil Forum pointed to the latest trends and challenges facing the oil sector on 8 and 9 October in Belgrade. Oil security, which came to the forefront following the recent attacks on Saudi crude facilities, and the transposition and implementation of the Oil Stocks Directive topped the agenda. The Forum also discussed cyber security threats in the oil sector and the potential impacts of a national attack on neighbouring countries.

Georgia to receive assistance in developing new standard terms and conditions for electricity contracts

The EU4Energy Governance project undertakes to support Georgia in developing new standard terms and conditions for direct contracts for the sale and purchase of electricity. The technical assistance was launched on 8 October with the participation of the Georgian National Energy and Water Regulatory Commission as well as the Georgian State Electro system (TSO) and the Electricity System Commercial Operator (ESCO) and will be delivered by the end of this year.

Energy Community Secretariat and the Agency for the Cooperation of Energy Regulators upgrade cooperation

on 7 October 2019

Today’s signature of an amendment to the Administrative Arrangement concluded between the Secretariat and the European Union Agency for Cooperation of Energy Regulators, ACER, in 2016 marks the starting point for further enhanced cooperation between the two institutions. The amendment grants the Secretariat the possibility to participate in the Market Integrity and Transparency Working Group of ACER. This will allow the Secretariat to closely follow EU regulators’ discussions on the REMIT Regulation and, by this, support the Energy Community Contracting Parties’ regulators to implement the REMIT Regulation aligned with EU developments. The amended Administrative Arrangement comes in time with the obligation of Contracting Parties to transpose the REMIT Regulation by end of November 2019.

2019 Gas Forum focuses on new gas infrastructure, innovative use of gas and future structure of supply routes

Taking place on 24 and 25 September in Ljubljana, the 14th Energy Community Gas Forum discussed regional gas markets and infrastructure, deploring inter alia the missed opportunity to bring the Serbian Gastrans exemption in line with European standards. On the table was also the future role of gas and innovation in the gas supply chain which will open up potential new uses of gas and related infrastructure in a sustainable manner. The Gas Forum endorsed actions aiming at adoption of the Clean Energy Package in the Energy Community.  “These will help us to work more efficiently with Contracting Parties especially from the perspective of security of supply,’’ explained Director of the Energy Community Secretariat Kopač. Among others, the Gas Forum discussed  the needed amendments to the Treaty establishing the Energy Community in order to make the organization more efficient.

Energy Community gas emergency exercise highlights need for coordination

The Energy Community Secretariat organized the first ever gas emergency exercise on 23 September 2019 in Ljubljana. The competent authorities, transmission system operators and gas undertakings of the Contracting Parties along with Greek representatives had to decide which internal emergency measures they would put in place in case of a prescribed gas disruption scenario. In addition, the exercise represented the first occasion when Contracting Parties had to plan and simulate how they would cooperate and exchange information with their direct neighbours, the Energy Community Secretariat and other countries such as EU Member States along the gas transport route.

EU4Energy to support development of new electricity procurement procedures in Moldova

On 9 September, the first stakeholder meeting to launch support for the update of the current electricity procurement procedures in Moldova took place in Chisinau. Until the end of the year, Energy Community Secretariat experts, representatives of the National Agency for Energy Regulation of the Republic of Moldova (ANRE) and other stakeholders (Moldelectrica, distribution system operators, suppliers) will work together to review the regulatory framework and draft new procurement procedures and framework contracts in order to establish an efficient process for electricity procurement in Moldova. Furthermore, an assessment and specifications of an efficient electronic process for electricity procurement will be prepared.

Cycling duo arrives in Kraków after 3,5 days journey

The Energy Community cycling duo arrived safely in Kraków on Thursday at 13:05pm after a 460-kilometre journey through Austria, Slovakia and Poland accomplished in three and a half days. Each cyclist saved 120.3 kgs of CO2 emissions compared to going by plane. The journey was closely followed on facebook by the 40 participants of the Energy Community Summer School who gave the cyclists a warm welcome upon arrival.

Director Kopač attends the inaugural session of the new Ukrainian Parliament

Today marked the inaugural session of the new Ukrainian Parliament, Verkhovna Rada. The Director of the Secretariat, Mr Janez Kopač, was honoured to attend the session as a special guest, together with the Vice President of the European Parliament, Ms Klara Dobrev, the President of the OSCE Parliamentary Assembly, Mr George Tsereteli, and the four former Ukrainian Presidents: Mr Kravchyk, Mr Kuchma, Mr Yuschenko and Mr Poroshenko. Dismissing the old Government, the new 424-member Parliament appointed Mr Alexey Goncharuk as the new Prime Minister. It also selected a new speaker and committees.

Energy Community duo cycles 460 km to this year’s Summer School to underscore importance of decarbonisation and sustainability

The Summer School participants were warmly welcomed by Janez Kopač, Director of the Energy Community Secretariat, Dirk Buschle, Dean of the Summer School and Secretariat’s Deputy Director, and Professor Andrzej Adamski, Proxy Rector at Jagiellonian University. The opening ceremony was also attended by senior representatives of the Polish Government and the European Commission.

EU4Energy Governance publishes brief on benefits of new law on energy efficiency in buildings for Georgian citizens

The EU-funded EU4Energy Governance project is assisting Georgia with the adoption of a new draft law on energy performance in buildings, and in preparing a series of building regulations. The new law will ensure that buildings are more energy efficient and wasted energy is reduced. Secretariat submits two Reasoned Requests to Ministerial Council

On 12 July 2019, two Reasoned Requests were submitted to the Ministerial Council for a decision under Article 91 of the Energy Community Treaty. One case (ECS-6/18) concerns the incomplete transposition and lack of implementation of the provisions of Directive 2001/80/EC on large combustion plants by Kosovo*, while the other (ECS-13/17) addresses the exclusion of interconnection point Horgoš from unrestricted third party access regime and capacity allocation mechanisms by the gas transmission system operator of the Republic of Serbia.

Informal Energy Community Ministerial Council focuses on treaty amendments and 2030 targets

Independence of the regulatory authority of Ukraine at risk

A ruling of the Constitutional Court of Ukraine of 13 June 2019 declared several provisions of the law establishing the national energy regulatory authority, NEURC, in violation of the country’s constitution. Besides concerns related to the dismissal and appointment of commissioners by the President of Ukraine, the Constitutional Court in particular held that NEURC’s status as an independent body is unconstitutional.

Secretariat continues dispute settlement procedures against Albania for lack of unbundling of electricity distribution operators

Director unveils final results of study on coal subsidies and their impacts at EU Sustainable Energy Week

Today at the EU Sustainable Energy Week, Director Kopač underlined the serious situation in the coal sector of the Energy Community Contracting Parties where direct subsidies amounted to EUR 1,2 billion in 2015-2017. On top of this, hidden subsidies, notably the non- payment of a carbon tax, totalled EUR 1,9 billion on an annual basis. In the three most coal intensive Contracting Parties (Bosnia and Herzegovina, Kosovo* and Serbia), coal subsidies were in absolute terms significantly higher than renewables support. The resulting market distortions and unsustainable consumption patterns are putting the region’s energy transition further at risk.

ECRB-MEDREG workshop highlights importance of regulatory cooperation for stimulating renewables uptake

Secretariat issues Opinion on the certification of the electricity transmission system operator MEPSO of North Macedonia

North Macedonia becomes third Contracting Party to launch competitive process for supporting renewables

Director Kopač on the Three Seas Initiative

This year, the Three Seas Initiative Summit and Business Forum took place in Ljubljana, Slovenia. Director Kopač moderated the Business Forum's Energy Panel, featuring interventions by United States Secretary of Energy, Rick Perry, and Polish Secretary of State in the Chancellery of the Prime Minister of Poland, Piotr Naimski. The panel was primarily dedicated to the challenges linked to the infrastructure redesign necessary to meet the needs of the low carbon economy transition. Director Kopač also held several side meetings, including with EU Commissioner for Mobility and Transport, Violeta Bulc, Slovenian Deputy Prime Minister, Alenka Bratusek, and Director-General for Economic Affairs and Sustainable Development at the German Foreign Office, Miguel Berger.

Ukraine and its EU neighbours agree to improve cross-border electricity trade

Electricity transmission system operators and energy regulators of Ukraine (Ukrenergo, NEURC) and four neighbouring EU Member States – Hungary (MAVIR, HEO), Romania (Transelectrica, ANRE), Slovakia (SEPS, URSO) and Poland (PSE) - agreed to jointly allocate capacity at their electricity interconnections at a meeting hosted by the Secretariat. Existing capacity allocation mechanisms are highly inefficient and create significant barriers to cross-border activities. Their improvement is key to allowing efficient commercial exchanges with EU Member States and advancing market integration. Ukraine’s capacity allocation regime has also to be brought in compliance with the acquis.

EU4Energy supports transposition of gas network codes in Moldova

Secretariat questions compliance of state guarantee for the Tuzla 7 project with the State aid acquis

On 26 March 2019, the Secretariat sent an Opening Letter to Bosnia and Herzegovina in Case ECS-10/18. It its letter, the Secretariat addressed its concerns with regard to the State aid compliance of a public guarantee granted in favour of the Export-Import Bank of China for a loan by the latter to the public utility Elektroprivreda BiH d.d. Sarajevo for the Tuzla 7 project. This guarantee has been found by the State Aid Council of Bosnia and Herzegovina not to contain elements of State aid.

Study shows EUR 2.4 billion given up for coal subsidies annually in the Energy Community

The Secretariat published today the preliminary results of a study revealing that the Energy Community Contracting Parties support electricity generated from coal with some EUR 2.4 billion of direct and certain types of indirect subsidies annually. The study concludes that with the elimination of state aid via direct subsidies to coal and introduction of a carbon price, not a single coal power plant in the Energy Community would be able to operate without significant losses. The study also shows that without direct and indirect subsidization of electricity generated from coal and other market distortions, in particular cross-subsidization between industry and households, the price of electricity to supply households would need to be increased by some 23% in Kosovo*, 29% in North Macedonia, 31% in Bosnia and Herzegovina, 37% in Montenegro and 49 % in Serbia. Under such conditions, prices for industrial consumers would have to be increased by 36% in Montenegro, 34% in North Macedonia, 30% in Bosnia and Herzegovina, 18% in Serbia, while in Kosovo* they would be decreased by 9%.

Energy and Climate Technical Working Group continues work on 2030 Energy Community targets methodology

Yesterday’s third Energy and Climate Technical Working Group continued to focus on defining the methodology for calculating 2030 targets for the Energy Community. The interim report was presented by a team of researchers from Technische Universität Wien, which discussed the upgraded methodology reflecting an ambition level comparable to EU Member States. The Secretariat was invited to continue working on the study with TU Wien, Joanneum and REKK, in close coordination with the European Commission and technical experts from the Contracting Parties. Once refined, the study will propose a range of targets that may be expected under aligned framework conditions in the Contracting Parties, taking into account differences in economic development.

Secretariat to support new fund for promoting use of renewable district energy in Western Balkans

Efficient district energy (heating and cooling) systems are perfect for the application of energy from renewable sources and use of waste heat. Renewables can be more affordable for the district energy system operators and end-customers, compared to energy from fossil fuels. However, their potential is greatly underexploited in the Western Balkans Region due to the lack of information and know-how. In addition, district energy systems operators are sometimes reluctant to invest resources in new technologies due to the lack of financial support.

Georgia to acquire energy performance certification system for buildings under EU4Energy support

On 15 March, the first meeting of the working group created in cooperation with the Ministry of Economy and Sustainable Development of Georgia, aimed at developing national regulations on certification of the energy performance of buildings and a template of the energy performance certificate for Georgia, took place in Tbilisi. Experts will work on developing a rating scheme for assessing energy performance and a classification system of buildings on a scale from A to G by calculating the specific annual primary energy consumption for each energy class, aligned with reference climatic data, compliant with Directive 2010/31/EU.

The new regime provides increased system efficiency, thus delivering benefits to Ukrainian energy consumers and the wider economy. North Macedonia becomes first Contracting Party to conduct a competitive tender for selection of universal service supplier

In line with the new Energy Law transposing the Third Energy Package, North Macedonia has launched a procedure to select the country’s universal electricity supplier and supplier of last resort for a period of five years. A consortium of EVN Macedonia and EVN supply won the competitive tender by offering the lowest supply margin compared to other bidders. This is the first such competitive tender procedure in the Energy Community.

Development of methodology for calculating natural gas transmission tariffs in progress for Georgia

Secretariat issues Reasoned Opinions against Kosovo* and Moldova for lack of transposition of emissions control legislation

On 19 February 2019, the Energy Community Secretariat brought one step further the dispute settlement procedures against Kosovo* and Moldova for the lack of transposition and implementation of legislation related to the emissions of large combustion plants. In its Reasoned Opinions, the Secretariat concludes that the missing or incomplete national environmental legislation in both Contracting Parties is a breach of obligations under the Energy Community Treaty, namely the Large Combustion Plants and Industrial Emissions Directives.

Secretariat welcomes energy agreement between North Macedonia and Kosovo*

Two Energy Community Contracting Parties, North Macedonia and Kosovo*, signed this week a Memorandum of Understanding on the Energy Sector. Under the Memorandum, they plan to revitalize electricity interconnection lines and potentially build a new gas interconnection, which would bring gas from nearby Skopje to Kosovo*. They also agreed to exchange experiences in the development of renewable energy sources in order to meet the requirements of the Energy Community Treaty.

EU4Energy technical assistance to support more energy efficient buildings in Moldova

On 13 February, Energy Community experts and representatives of the Ministry of Economy and Infrastructure of Moldova met in Chisinau to set in motion technical assistance to support the Moldovan Government in the implementation of Law no 128/2014 on Energy Performance of Buildings. The support will consist of updating the minimum energy performance requirements for new buildings and those that undergo major renovations. Application of the new building requirements will result in the lowest energy costs during the estimated economic lifecycle of the building.

Gastrans pipeline project: Secretariat issues opinion with request for additional conditions to Serbian energy regulator

Today, the Secretariat notified the energy regulatory authority of Serbia, AERS, of its opinion on the exemption granted by AERS to the pipeline project Gastrans on 1 October 2018. Gastrans is a project for a new pipeline on Serbian territory which is expected to be linked with new pipeline infrastructure to be built upstream in Bulgaria and downstream in Hungary. AERS had exempted the project from the provisions of the Third Energy Package related to unbundling, third party access and tariff regulation. In its opinion, the Secretariat requests a number of conditions to ensure the project does not lead to market foreclosure in Serbia and beyond.

EU4Energy presents first draft methodology for calculating natural gas transmission tariffs for Georgia

On 16 January, EU4Energy Governance held a stakeholder meeting in Georgia to present and discuss the first draft of the proposed gas transmission tariff methodology and calculation tool. Representatives of the Georgian National Energy and Water Supply Regulatory Commission (GNERC), Georgian Gas Transmission Company (GGTC) and other gas transmission system users exchanged views on the potential impact of the various options within the proposal. The technical assistance will enable GNERC to calculate the applicable tariffs based on the developed methodology, and implement in practice the entry-exit tariff system in line with the provisions of Commission Regulation (EU) 2017/460 on establishing a network code on harmonised transmission tariff structures for gas.

EU4Energy Governance newsletter highlights benefits of energy reforms for citizens

In this period, new assistance was launched in Ukraine for the transposition of the regulation aimed at facilitating investments in energy infrastructure projects.

Secretariat publishes rules on access to dispute settlement case files

The Secretariat has adopted detailed rules governing access to case files under the Energy Community Dispute Settlement Procedure. The rules specify the requirements and procedure for accessing a case file. Contracting Parties, Participants and Observers under the Energy Community Treaty and the complainant have a right to access case files, while private or public bodies must first prove they have a legitimate interest in the case.

Moldova takes over Energy Community Presidency

Moldova took over the rotating presidency of the Energy Community on 1 January 2019. Moldova’s top priority during the presidency will be finalizing the discussion and finally adopting amendments to the Treaty establishing the Energy Community. The discussion on Treaty amendments is going on already for the last three years and it is high time to finish it before EU parliamentary elections. Amendments are necessary to ensure that the Energy Community can fulfil its objectives and live up to the requirements of a single energy market.

Ukrainian parliament to pass major overhaul of renewable energy support schemes

Yesterday, Verkhovna Rada of Ukraine passed in first reading the Law on auctions for the support of electricity produced from renewable energy sources. After a long process of consultation with hundreds of stakeholders and eight different draft laws promoted by different groups of Members of Parliament, this draft Law is a well-balanced result which will put Ukraine on a sustainable energy path.

Regulatory School Advisory Committee releases training course programme for 2019

EU4Energy assists Moldova in updating energy performance of buildings calculation methodology

On 17-18 December 2018, the second meeting of the working group created in cooperation with the Ministry of Economy and Infrastructure of Moldova, aimed at updating the methodology for calculation of energy performance of buildings (EBP), took place in Chisinau. The assistance is part of the EU4Energy support for the country in fulfilling its commitments under the Energy Community Treaty, transposing the main provisions of Directive 2010/31/EU and builds on the gap analysis of Law no 128/2014 on Energy Performance of Buildings in Moldova, developed with EU4Energy support last year.

The instrument brings together developed and developing countries sharing the highest level of ambition in the international climate talks. The statement was endorsed by Mr. Jani Makraduli, Deputy Minister for Environment and Physical Planning of Macedonia. The Secretariat strongly supports former Yugoslav Republic of Macedonia in its climate ambitions.

associations of energy regulatory authorities. Presidents Garrett Blaney of CEER, Giorgi Pangani of the ECRB and Gülefşan Demirbaş of MEDREG signed a Cooperation Arrangement that will
strengthen regulatory cooperation between energy regulators across Europe through to the
Mediterranean, South East Europe and Black Sea regions.

At its 41st plenary meeting, the Energy Community Regulatory Board (ECRB) set out its objectives and priorities for the upcoming year. The Work Programme 2019 includes the continuation of monitoring reports on gas and electricity wholesale and retail markets and transparency of the gas sector. A deeper focus will be put on the implementation of new acquis, in particular the Third Package gas and electricity network codes, and the provision of coordinated regulatory input to support electricity market coupling.

16th Energy Community Ministerial Council adopts key energy infrastructure projects, sets direction for adopting 2030 energy and climate targets

Today’s 16th Ministerial Council took key decisions for the future of the Energy Community under the chairmanship of H.E. Kreshnik Bekteshi, Minister of Economy of former Yugoslav Republic of Macedonia. Opening host speeches by Prime Minister H.E. Zoran Zaev and Deputy Prime Minister H.E. Koco Angjushev underlined that energy has no boundaries and regional cooperation is of greatest importance. As a boost for regional energy market integration, the Council adopted twenty-one infrastructure projects of regional significance, which will also enhance security of energy supply, increase energy efficiency and the uptake of energy from renewable sources. The ministers also agreed to re-open negotiations on amendments to the Treaty establishing the Energy Community which, once adopted, will help enhance market integration between Energy Contracting Parties and EU Member States.

Joint Energy Community Secretariat - EBRD event explores establishment of a Ukrainian gas exchange

On 19 November in Kyiv, foreign and Ukrainian stakeholders, including exchanges, transmission system operators, traders, regulators, government representatives and international financial organizations, gathered together to discuss the establishment of a gas exchange in Ukraine. The participants endorsed a gas exchange implementation roadmap, which foresees the establishment of a fully functional gas exchange with clearing services, as well as a blueprint of what a Ukrainian gas exchange could look like and the key steps needed to get there, developed with the support of the European Bank for Reconstruction and Development (EBRD) and the Energy Community Secretariat. The next stage of the process will be the formalisation of the cooperation between Ukrainian authorities, EBRD and the Secretariat.

Draft methodology for calculating tariffs for ancillary services presented under EU4Energy

On 20 November 2018, the draft methodology for calculating tariffs for ancillary services such as voltage control and black start that might be procured under a regulated process, if needed for a transitional period, was presented to the National Energy and Utilities Regulatory Commission (NEURC) and state enterprise NPC “Ukrenergo” in Ukraine under the framework of EU4Energy technical assistance. The new methodology will ensure efficient cost allocation in the procurement of ancillary services and effective functioning of electricity markets.

Secretariat’s Implementation Report 2018: Energy Community has to step up efforts to prepare for the clean energy transition

The Energy Community Secretariat’s Annual Implementation Report, released today, underlines that the Energy Community Contracting Parties have made progress in reforming their energy sectors, but upgraded efforts are needed. This is especially important if the clean energy transition is to succeed in the Energy Community. The Report, which was revamped to provide an even more accurate snapshot of the progress achieved by the Contracting Parties, concludes that the average implementation score is at around 43%. For the first time, the report comprises all nine Energy Community Contracting Parties, including the newest member Georgia.

Secretariat invites interested parties to send observations on the exemption decision for the Gastrans natural gas pipeline project

The Serbian energy regulatory authority (AERS) in its decision of 1 October 2018 granted an exemption to Gastrans d.o.o. for its natural gas pipeline project from the obligation of third party access rules, regulated tariffs and ownership unbundling. The pipeline is planned to span from the Bulgarian-Serbian border to the Serbian-Hungarian border including exit points to the Serbian system. AERS submitted its exemption decision to the Secretariat, which is currently preparing an Opinion on the decision.

Lower wholesale energy prices translate into lower retail prices for the second year in a row

Average energy retail prices for households in the EU decreased in 2017, reflecting for the second consecutive year the decline of energy wholesale prices in preceding years, also thanks to market integration. However, the non-contestable part of the bill (network costs, taxes, levies and other charges) continued to increase. Some of the non-contestable components of the bill have supported the development of renewable energies, which are key for the EU to fulfil the objectives of the Paris agreement against climate change.

In June 2017, the European Commission opened proceedings against Transgaz, the manager and operator of the national gas transmission network in Romania, for potential breach of EU competition rules as regards the flow of natural gas from Romania to other Member States, in particular Hungary and Bulgaria (Case AT.40335 – Romanian gas interconnectors). In September 2018, Transgaz offered commitments pursuant to Article 9 of Regulation (EC) No 1/2003 to meet the competition concerns raised by the Commission. The commitments concern an increase of export capacities at the interconnection points with Hungary and Bulgaria, non-discrimination between export and domestic tariffs, and generally any other anti-competitive conduct. In order to test whether these commitments effectively remove the competitive concerns, the European Commission invited interested parties to submit their observations on the proposed commitments of Transgaz.

On 8 October, participants of the Energy Community Summer School gathered for the Constitutive General Assembly of the Energy Community Summer School Alumni Association. The Association elected members of the Executive Board, for position of the Chairman – Quentin Boulanger (France), the Deputy – Nevin Alija (Albania), the Secretary – Varvara Aleksić (Serbia) and the treasurer – Andreas Schröder (Germany), and two controllers – Jolita Hoxholli (Albania) and Andrej Haug (Germany). The Executive Board discussed initial projects with the aim to establish a network of alumni of the Energy Community Summer School.

Serbia and Russia remove destination clause from gas supply agreement

On 27 September 2018, the Serbian parliament approved the removal of the destination clause included in the 2012 inter-governmental agreement between the government of the Republic of Serbia and the government of the Russian Federation for the supply of natural gas. This agreement provided that the gas supplied on its basis is intended for use in the Serbian market only, thereby restricting the territory to which the Serbian buyer can sell the gas. Such destination clause constitutes a violation of Energy Community competition law.

Secretariat welcomes launch of residential energy efficiency programme in Serbia under REEP Plus

On 26 September, the European Bank for Reconstruction and Development (EBRD) officially launched the start of a new Green Economy Financing Facility (GEFF) for Serbia that will provide loans to households for energy efficiency improvements. The GEFF, established with the support of the Energy Community Secretariat, will help Serbia to put measures under the Energy Efficiency and Energy Performance of Buildings Directives into action.

WB6 Initiative continues efforts to create a regional electricity market

The WB6 Electricity Initiative continued with a series of meetings organised by the Energy Community Secretariat on 24-26 September in Vienna. The WB6 stakeholders were joined by representatives of all neighbouring EU Member States - Bulgaria, Croatia, Greece, Hungary, Italy and Romania, to discuss the way forward for day-ahead market coupling, cross-border balancing and coordinated capacity calculation. Entering the final stages of preparation, all three projects are expected to be transformed into concrete contractual and governance frameworks to be implemented by all stakeholders.
