Energy regulator of North Macedonia joins ACER’s electricity working group

On 23 May, the Agency for the Cooperation of Energy Regulators (ACER) and the Energy and Water Services Commission of North Macedonia (ERC) signed an agreement that formalizes ERC’s participation in ACER’s electricity working group. This follows an assessment of the Energy Community Secretariat on compliance of North Macedonia with Third Package requirements in the electricity sector and regulatory independence as well on environmental, competition, climate and renewables performance.

Implications of CBAM for Contracting Parties discussed at Energy Community high-level event in Brussels

With the conclusion of the negotiations on the European Commission’s proposal on the carbon border adjustment mechanism (CBAM) around the corner, the Energy Community brought together key stakeholders to take stock of the opportunities and challenges posed by the implementation of the CBAM instrument. Participants recognized the beneficial role that CBAM could have on incentivizing increased decarbonization efforts and compliance with the Energy Community emission reduction rules.

Secretariat expresses concern about regulatory uncertainty in Kosovo*

on 23 May 2022

During their mission to Kosovo*, Director Lorkowski, Deputy Director Buschle and Electricity Expert Kllokoqi met the Deputy Prime Minister Besnik Bislimi, Minister of Economy Artane Rizvanolli and Deputy Minister for Environment, Spatial Panning and Infrastructure Linda Cavderbasha. They also held meetings with representatives of the Parliamentary Committee responsible for energy, the Energy Regulatory Office and other energy stakeholders. The discussions focused on the transposition of the Clean Energy for all European Package, the forthcoming Network Codes and Guidelines for electricity, Kosovo*’s Energy Strategy and the National Energy and Climate Plan. The Secretariat committed to support the Kosovan authorities in developing the legal acts necessary for regional market integration and attracting investments in renewables.

EU External Energy Strategy defines Energy Community as instrument for ambitious energy and climate policies and market reforms

Published by the European Commission today, the new EU External Energy Strategy defines the Energy Community as the framework for promoting ambitious energy and climate policies and market reforms. The Strategy is part of the REPowerEU Plan that aims to end the EU's dependence on Russian fossil fuels and tackling the climate crisis and sets out how the EU will work together with its neighbours.

Energy Community Parliamentary Plenum debates energy security amidst Russian invasion of Ukraine

Parliamentarians of the Energy Community Contracting Parties and the European Parliament met today in Brussels under the umbrella of the Energy Community Parliamentary Plenum. In the presence of EU Commissioner for Energy Kadri Simson, Members of Parliament discussed how to strengthen Europe’s energy security following Russia's invasion of Ukraine. Support for the energy sector of Moldova and Ukraine and enhanced European energy market integration were also discussed.

Moldova takes first step towards electricity supply diversification

Moldova’s main electricity supplier, Energocom, has signed a contract with the Ukrainian hydropower producer, Ukrhydroenergo, for supplying around 30% of demand in Moldova for the period from 12 until 31 May 2022.

Secretariat initiates dispute settlement procedure against Moldova for lack of virtual reverse gas flow

on 12 May 2022

Today, the Secretariat submitted an Opening Letter to Moldova to address its failure to adopt the legal framework necessary for the transmission system operator to effectively offer backhaul capacity. In the Opening Letter, the Secretariat preliminarily concludes that although Moldova transposed the provision of the network code obliging transmission system operators to offer backhaul capacity, it failed to adopt necessary provisions for the customs clearance of such transactions.

Secretariat’s task force coordinates delivery of 60 metric tons of critical energy equipment to Ukraine

The Secretariat’s Ukraine Support Task Force is continuously working to keep the lights on in Ukraine during the conditions of war. Cooperating closely with the EU’s Emergency Response Coordination Centre, the Task Force has supported the delivery of more than 60 metric tons of emergency energy equipment donated by companies across Europe.

Energy Community Security of Supply Coordination Group holds emergency talks on gas supplies

The Energy Community Security of Supply Coordination Group assessed possible risks facing each Contracting Party in case of a gas supply disruption from Russia and measures to help soften its impact at yesterday’s emergency meeting. The Group recalled the importance of risk preparedness, diversification of energy supply and necessity to remove any regulatory obstacles hindering the flow of gas. Infrastructure bottlenecks were also discussed.

Energy Community Secretariat on high-level mission to Moldova

on 6 May 2022

Director Lorkowski and Deputy Director Buschle met the President of Moldova Maia Sandu, the Prime Minister Natalia Gavrilita, and the Minister for Infrastructure and Regional Development, Andrei Spinu, during their mission to Moldova this week. The discussions focused on practical measures to support Moldova in ensuring electricity supply from Ukraine in the short-term and setting up an internal mechanism enabling efficient cross-border exchanges on a continuous basis with Ukraine and later also with Romania.

Director Lorkowski on working visit to Albania

Director Lorkowski held meetings with key government representatives and energy stakeholders during his visit to Tirana on 27 and 28 April. The Director discussed the state of energy and climate reforms with Deputy Prime Minister Arben Ahmetaj, Minister of Infrastructure and Energy Belinda Balluku and Minister of Tourism and Environment Mirela Kumbaro. He also met with representatives of the Parliament of Albania and board members of the National Regulatory Authority.

Energy Community welcomes Ukrenergo’s observer membership in ENTSO-E

First donation to Ukraine Energy Support Fund ready for disbursement  

on 25 April 2022

Following the signature of a Fiduciary Agreement between the Ministry of Energy of Ukraine, the Secretariat and the Ministry of Climate, Energy and Utilities of Denmark, the Ukraine Energy Support Fund has received the first donation from the Government of Denmark. The donation will be used to purchase much needed emergency energy equipment, fuels for electricity production and heating and provide other types of support.

Energy and Climate Committee discusses way forward for 2030 targets

The 8th Energy and Climate Committee met on 12 April in Vienna, in the presence of the EU Commissioner for Energy, Kadri Simson. The meeting provided an opportunity for Ministers and Deputy Ministers of Energy Community Contracting Parties to discuss the process for setting 2030 energy and climate targets. Deputy Prime Minister and Minister of Mining and Energy of Serbia, Zorana Mihajlović, received the Committee’s endorsement as co-chair, joining in this role previously appointed Deputy Prime Minister for European and Euro-Atlantic Integration of Ukraine, Olha Stefanishyna.

Secretariat discusses Montenegro’s energy and climate plans

Today, the Secretariat held a working meeting with State Secretary responsible for Energy, Marko Perunović, and Director-General of Directorate for Energy and Energy Efficiency, Mr. Vladimir Durutović. The meeting focused on plans and projects pursued by Montenegro in its efforts to end the dependency on coal. Both sides also exchanged on sectoral reforms in key areas such as electricity, gas, renewables and energy efficiency. Energy Community Secretariat to act as fiduciary of the Ukraine Energy Support Fund

on 5 April 2022

Upon request by the European Commission and in agreement with the Ministry of Energy of Ukraine, the Energy Community Secretariat set up the legal framework for the Ukraine Energy Support Fund to counteract the impact of the Russian invasion. The Fund will enable governments and international financial institutions to provide emergency financial support to the Ukrainian energy sector. The Secretariat will act as fiduciary of the Fund as well as an intermediary between the donors and the Ukrainian authorities.

Director Lorkowski discusses way forward in energy and climate reforms with key stakeholders in Georgia

Environmental concerns increase with decision on lifetime extension of Tuzla 4 and Kakanj 5

On 24 March, the House of Peoples of the Parliament of the Federation of Bosnia and Herzegovina endorsed conclusions to cancel the application of the opt-out regime of the Large Combustion Plants Directive for two power plants, the TPPs Tuzla 4 and Kakanj 5. With the conclusions endorsed by the House of Peoples, the intention is to extend their operation until 2028. In the Secretariat’s opinion, such a unilateral decision is a clear breach of the obligations of Bosnia and Herzegovina under the Energy Community Treaty.

Secretariat commends accelerated power system synchronization of Ukraine and Moldova with ENTSO-E

Today marks the start of trial synchronization of the power systems of Ukraine and Moldova with the Continental European power system, as a milestone towards permanent synchronization in the future. This follows the request by the two Energy Community Contracting Parties for emergency synchronization after the completion of isolated mode tests during which their electricity systems proved reliable and stable in spite of the extremely challenging circumstances caused by the Russian invasion.

Secretariat facilitates donor coordination on energy efficiency and climate

Nine leading donor and international financial organizations gathered yesterday at a meeting hosted by the Secretariat to discuss the technical assistance and capacity building needs of the Contracting Parties and how they can best be matched with donor programmes. Support for the implementation of the Clean Energy Package and the Green Agenda for the Western Balkans were identified as priority areas. Participants welcomed the Secretariat’s Donor Coordination Platform, featuring over 200 projects, as a useful tool for improving the effectiveness and ensuring synergies in donor support in the Energy Community Contracting Parties.

Nuclear power plant Chernobyl disconnected - Urgent action required

The Secretariat is very concerned regarding the news about the decommissioned nuclear power plant Chernobyl being disconnected from the electricity network and hence staying without electricity supply, as reported today by the transmission system operator of Ukraine, Ukrenergo. A secure power supply is of the utmost importance for cooling radioactive waste in this power plant. Against this background, the Secretariat appreciates the efforts currently made by ENTSO-E to connect the Ukrainian power system as soon as possible with the one of Continental Europe.

Secretariat voices deep concern for all women and girls affected by war 

on 8 March 2022

In these extraordinary times when war is raging on the European continent and on the occasion of the International Women’s Day, the Secretariat would like to reiterate its solid commitment to gender equality and deep concern for all women, girls and children who are disproportionately affected by the ongoing war. Women’s voices need to be heard, especially now. As underlined by Director Lorkowski when joining the International Gender Champions (IGC) leadership network, “This should start with recognizing that women are disproportionally impacted by issues like energy poverty and climate change, but also by ensuring that women and men are equally represented at the decision-making table.” In this regard, we would like to highlight the pledge made by Director Lorkowski to stop all forms of gender-based violence and no longer take part in single-sex panels as part of his IGC membership.

This is war: Europe’s energy security depends on full synchronisation of Ukraine and Moldova with the EU electricity system

Since 24 February, the Ukrainian and Moldovan power systems have been operating in isolated mode. The planned isolated mode test is part of their preparation to fully synchronize with the interconnected power systems of the synchronous area of Continental Europe. The Ukrainian and Moldovan systems proved to be stable despite the extremely challenging conditions caused by the Russian invasion. But the Ukrainian and Moldovan power systems continue to be under threat, and so do the lives of citizens depending on those systems.

Energy Community meets 2020 headline target for energy efficiency, makes progress on renewables

Security of supply: Ukraine better prepared in case of gas disruption

Secretariat issues recommendations on Albanian draft National Energy and Climate Plan

Albania is the second Contracting Party to finalize and submit its draft National Energy and Climate Plan (NECP) to the Secretariat for review. Based on the Ministerial Council Recommendation 2018/01/MC-EnC, the Secretariat issued its recommendations on the draft NECP of Albania. The Secretariat concluded that the draft constitutes a comprehensive overview of current and planned measures. However, there is room for additional policies in order to ensure that Albania embarks on structural reforms that help decouple its economic growth from greenhouse gas emissions.

Certification of Ukrainian electricity transmission system operator completed

Household consumption surveys supported by Energy Community completed

Secretariat’s new Director on working visit to Moldova

Study paves way to better understand causes of energy poverty and proposes policies for its mitigation in the Energy Community

Today, the Secretariat published a study on addressing energy poverty in the Energy Community Contracting Parties. The study estimates the number of energy poor households, analyses the legal frameworks for the protection of vulnerable and energy poor consumers and investigates the main drivers and causes of energy poverty in the Contracting Parties. Efforts to address energy poverty are part of the Energy Community Just Transition Initiative to ensure that the move away from fossil fuels in the Contracting Parties is socially just, in the interest of women, workers and entire communities.

Secretariat’s Opinion on unbundling of Ukrainian transmission system operator Ukrenergo under the Third Energy Package

Today, the Energy Community Secretariat published its Opinion 4/21 of 25 November 2021 on the unbundling of the Ukrainian electricity TSO Ukrenergo. The Opinion supports the certification of Ukrenergo by the Ukrainian regulatory authority NEURC. However, in its Opinion the Secretariat raises concerns about the financing of the TSO from transmission tariffs, which are to cover also compensation for renewable energy projects under the existing legislation. The Secretariat also expects that a new and largely independent supervisory board of Ukrenego will take office immediately.

Ministerial Council decides in the Tuzla 7 case

on 1 December 2021

At its meeting yesterday, the Ministerial Council decided that Bosnia and Herzegovina breached its obligations under Energy Community law with regard to the Tuzla 7 project.  The public utility Elektroprivreda Bosne i Hercegovine intends to build a new lignite fired power plant in Tuzla financed by a loan of the Chinese Export-Import Bank. The Federation of Bosnia and Herzegovina issued a guarantee to secure this loan. The national State Aid Council decided that the terms under which this guarantee was granted does not involve State aid. The Energy Community Treaty includes a principle prohibition of State aid in Article 18.

Prime Minister of Kosovo* visits Secretariat

Yesterday, Prime Minister Albin Kurti visited the seat of the Energy Community Secretariat in Vienna to discuss Kosovo*’s future energy strategy and a range of ongoing reform measures, such as the market coupling with Albania and increasing payment discipline. The Prime Minister met with Deputy Director Dirk Buschle and Arben Kllokoqi, Electricity Expert. The Secretariat will support Kosovo* on its transition pathway, which faces unique challenges but offers plenty of opportunities for increased competitiveness and resilience.

North Macedonia’s energy regulator joins ACER’s electricity working group

on 23 November 2021

The Agency for the Cooperation of Energy Regulators (ACER) admitted the Energy and Water Services Commission of North Macedonia (ERC) to join its Electricity Working Group as observer. ERC is the second Contracting Party regulator to achieve this status following a positive assessment by the Energy Community Secretariat of the country’s compliance with Third Package requirements in the electricity sector and regulatory independence as well its environmental, competition, climate and renewables performance.

Mediator’s concluding report on Namakhvani HPP in Georgia

Today, the Secretariat’s Dispute Resolution and Negotiation Centre published the concluding report on the mediation in a dispute concerning the Namakhvani hydropower plant project in Georgia. Parties to the mediation were the government as well as a number of civil society organizations and local campaigners. The mediation lasted for six months, as scheduled. It resulted in a number of agreements and follow-up actions summarized in the report. At the end of September, the project developer, who chose not to participate in the mediation, had unilaterally terminated the project contract.

Secretariat initiates dispute settlement procedure against Moldova for lack of unbundling of gas TSO Moldovatransgaz

Today, the Secretariat submitted an Opening Letter to Moldova to address its failure to comply with the provisions on unbundling and certification of its gas transmission system operator (TSO) Moldovatransgaz. In the Opening Letter, the Secretariat preliminarily concludes that the TSO is not unbundled according to the requirements of the chosen Independent Transmission Operator (ITO) model.

Advisory Committee confirms Secretariat’s assessment in case concerning the Tuzla 7 coal TPP project

on 18 November 2021

On Monday, the Advisory Committee rendered its opinion in Case ECS-10/18 against Bosnia and Herzegovina. The case concerns a public guarantee granted by the Federation of Bosnia and Herzegovina in favour of the Export-Import Bank of China for a loan by the latter to the public utility Elektroprivreda BiH d.d. Sarajevo for the Tuzla 7 project. This guarantee has been found by the State Aid Council of Bosnia and Herzegovina not to contain elements of State aid. The Advisory Committee has confirmed the Secretariat’s argumentation that the State Aid Council’s decision does not comply with the State aid acquis and that the public guarantee constitutes State aid.

State aid authority of Serbia approves renewables support scheme

On 4 November 2021, the Serbian Commission for State Aid Control rendered its decision regarding decrees in the framework of the support scheme for renewable energy, in particular the decree on the market premium and feed-in tariff, the decree on quotas and the model contract for market premium. It found that these measures contain elements of State aid which were however compatible and therefore were approved by the Commission.

Annual Implementation Report 2021: Modest reform gains as Energy Community embarks on the energy transition

The Energy Community Secretariat’s Report published today reveals that the Energy Community Contracting Parties have made progress in reforming their energy and climate sectors. In fact, the average implementation score increased from 53% to 56% in the reporting period. However, the overall pace of reform slows down. It was only half that of the previous reporting period.

Over the years, market players have raised numerous issues with access to gas transmission capacity at the borders between the European Union (EU) and the Energy Community, as well as within the Energy Community itself. As a consequence, the EU Agency for the Cooperation of Energy Regulators (ACER) and the Energy Community Secretariat jointly held a public consultation to investigate how the market assesses access to capacity in the region, receiving 15 responses. As a follow up of the analysis, ACER and the Secretariat publish today a joint summary note of the responses.

Decarbonisation of district heating in the spotlight

Ukraine’s regulator submits new preliminary decision on certification of electricity transmission operator to the Secretariat

On Friday, 1 October 2021, the National Energy and Utilities Regulatory Commission of Ukraine (NEURC) adopted a new Preliminary Decision on certification of the Ukrainian Transmission System Operator for electricity – Joint Stock Company National Power Company Ukrenergo, and invalidated the Preliminary Decision adopted on 2 June 2021. NEURC preliminarily certified Ukrenergo under the independent system operator (ISO) model of unbundling.

On 7 September, the Secretariat was accepted to the Austrian registry of organisations implementing an Environmental Management and Audit Scheme (EMAS). The certification marks the completion of a 1 ½ year-long project.

Agreement between Makpetrol and North Macedonia concerning the gas system operator fully implemented

Energy Community Summer School helps its participants in shaping the energy transition

The fifth edition of the Energy Community Summer School kicked off on 21 August at the premises of the Energy Community in Vienna. Taught over the course of one week at Vienna University, the Summer School will help empowering a new generation of energy and climate professionals to engage in the energy sectors in transition. Joining the group of forty postgraduate students and young professionals, five journalists from the region will receive a specialized training on energy journalism organized by the Friedrich-Ebert-Stiftung.

Exchange programme for coal regions to share experiences with implementing just transition to clean energy

Coal regions in the Western Balkans, Ukraine and the EU are invited to join an exchange programme to accelerate just local energy transitions. The programme is an opportunity for regions to start direct, one-to-one dialogues, connect with different stakeholders, learn from each other, and transfer knowledge.  The exchange programme is part of the Initiative for coal regions in transition in the Western Balkans and Ukraine, managed by the European Commission in cooperation with the Energy Community, the World Bank, EBRD, EIB, Poland’s National Fund for Environment Protection and Water Management and the College of Europe in Natolin.

The Namakhvani HPP dispute in Georgia – an update by the mediator

The dispute between public institutions of Georgia and a number of NGOs and local protesters opposing the hydropower project on the Rioni river in Western Georgia needed a channel for direct discussions and work towards solutions. The mediation provides that channel. After a first session on 12 June 2021 in Natakhrari outside Tbilisi, the parties have been jointly working on the implementation and prepare the move to the next stage of the mediation.

On 21 July 2021, a Memorandum of Understanding about trans-regional cooperation on the development of an integrated South-Eastern and Eastern European gas (SEEGAS) market was signed by the Energy Community Secretariat, energy exchanges and trading service providers BRM, UEEX, TGE, CEEGEX and ECG and transmission system operators Moldovatransgaz, GTSOU, FGSZ and GAZ-SYSTEM. The signatories aim to cooperate on the development of cross-border natural gas trading, e.g. on exchange platforms, and introduce transparent and competitive interregional market-based pricing mechanisms and efficient cross-border gas transmission and interoperability.

Secretariat publishes opinion on certification of Moldovan gas transmission system operator Vestmoldtransgaz under Third Energy Package

Today, the Energy Community Secretariat published its Opinion 2/21 on the certification of the Moldovan gas transmission system operator Vestmoldtransgaz under the Third Energy Package. Before its commercial operation date (envisaged for 1 October 2021), Vestmoldtransgaz is not yet performing actual transmission services, but fulfills other important tasks of a transmission system operator. The Opinion largely supports the certification of Vestmoldtransgaz in line with the Moldovan regulatory authority’s (ANRE) Preliminary Decision.

The Gas Wholesale Market Volume of the Annual Monitoring Report 2020 was released today by the EU Agency for the Cooperation of Energy Regulators (ACER) and the Council of European Energy Regulators (CEER). Once again, the report covers gas market developments in the Energy Community Contracting Parties based on data provided by the Contracting Parties’ national regulatory authorities. The other two volumes, namely, electricity wholesale and retail and customer protection, will be released later this year.

LLC Ukrainian Energy Exchange becomes first licensed commodity exchange in Ukraine

On 1 July 2021, the law on commodity exchanges introducing rules to regulate activities of the exchange market and establishing the basic requirements for such activities entered into force in Ukraine, replacing an outdated law from 1991.  Based on this law, the National Securities and Stock Market Commission, the regulator in charge of exchange trading, issued the first license for the organization of commodity products trading and clearing activities to LLC Ukrainian Energy Exchange.

CARI is an initiative launched by the Vienna-based Energy Community Secretariat and supported by the Hungarian Western Balkans Green Center (WBGC).

The deadline foreseen by the Energy Community acquis for transposition was 1 January 2019.

The Namakhvani mediation – follow-up on Saturday’s meeting

This Saturday, the first meeting in the negotiations between civil society and the government of Georgia concerning Namakhvani hydropower project on the Rioni river took place outside Tbilisi. The parties agreed on a number of measures and actions to be taken on three main subjects: effective and transparent control of the conditions in the construction and environmental permits and their review by independent experts, a de-escalation of the situation in the Rioni valley review, and an open debate on Georgia’s future energy security on the basis of the draft National Energy and Climate Plan. The negotiations were mediated by the Secretariat's Dispute Resolution and Negotiation Center.

Cooperation will take the form of knowledge sharing and exchange programs under the newly created Center of Excellence in Green Transition for the Western Balkans (CEGT) as part of the WBGC, to be based in Budapest, with additional external events and capacity support at the seat of the Secretariat in Vienna. All actions will be in line with the Paris Agreement, the European Green Deal and the Sofia Declaration on the Green Agenda for the Western Balkans.

Implementation of renewables self-consumption schemes at the heart of new Renewable Energy Coordination Group’s Work Programme

Yesterday’s Renewable Energy Coordination Group meeting featured discussions on progress in the field of renewable energy and set the Group’s priorities for the next two years. Alongside adopting its Work Programme for 2021-2022, the Group appointed Ms. Margalita Arabidze as its Chair for the same period. The meeting also explored how spatial planning can accelerate renewable energy uptake, which concluded with the Secretariat’s proposal to coordinate the development of policies and measures for the identification of suitable zones for renewable energy projects as part of the implementation of National Energy and Climate Plans (NECPs).

Conference highlights need for coordinated approach and capacity building to fight off cybersecurity threats in the Energy Community

At the second Energy Community cybersecurity day hosted by the Secretariat, experts provided insights into the latest developments in the cybersecurity domain and their implications for regulators, governments and industry in the Contracting Parties. Participants agreed that the digital transformation of the energy sectors can only succeed with strengthened cybersecurity capabilities in place and increased cooperation on cybersecurity issues at the level of the Energy Community and with EU Member States.

Secretariat initiates dispute settlement procedure against Moldova for lack of unbundling of its electricity TSO

Today, the Secretariat submitted an Opening Letter to Moldova to address its failure to comply with the provisions on unbundling and certification of transmission system operators in Articles 9 and 10 of the Electricity Directive.

Secretariat submits Reasoned Request against Bosnia and Herzegovina for lack of DSO unbundling to Ministerial Council

Yesterday, the Secretariat submitted a Reasoned Request to the Ministerial Council for a decision under Article 91 of the Energy Community Treaty in Case ECS-5/17. The case concerns the failure of Bosnia and Herzegovina to rectify the breaches identified by the Secretariat related to unbundling of the distribution system operators in accordance with the requirements of Article 26 of the Directive 2009/72/EC.
