Secretariat signs multilateral memorandum on developing a gas exchange in Ukraine

A Memorandum of Understanding between the Energy Community Secretariat, the Ministry of Energy of Ukraine, the European Bank for Reconstruction and Development and the Commodity Exchange Ukrainian Energy Exchange was signed today. The agreement provides the general framework and conditions for cooperation to support the establishment of a natural gas exchange based on the Commodity Exchange Ukrainian Energy Exchange.

Georgia to receive assistance in developing contractual frameworks to support low-carbon electricity generation

The EU4Energy Governance project undertakes to support Georgia in developing a standard form and template for a Contract for Difference, a market-based mechanism for supporting renewables based electricity generation. Georgia introduced a provision on Contracts for Difference in its recently adopted Renewable Energy Law, however, the necessary contractual framework for its implementation is not yet developed.

Cybersecurity Group strengthens cooperation amid cyber-attack risks posing the highest threat to energy system security

On 17 July 2020, as many as 40 participants joined the virtual meeting of the Energy Community Cybersecurity Coordination Group. The overall messages were clear: the Covid-19 pandemic proved that energy system digitalization must be cyber-secure by all means and cyberattacks currently pose the highest risk for energy system security. Enhanced cooperation at the level of the Energy Community could help tackle cybersecurity incidents and threats more effectively.

Secretariat proposes legal measures to support go-live of electricity market coupling projects between Contracting Parties and EU Member States

At yesterday’s virtual meeting, the Secretariat outlined its new concept for a staged implementation of EU Regulation 2015/1222 on electricity capacity allocation and congestion management (CACM Regulation) in the Energy Community to electricity market participants from the EU and Contracting Parties. The interest and active contributions of more than 80 representatives of regulators, electricity network operators, market operators, Agency for the Cooperation of Energy Regulators (ACER) and the European Commission underscored the timeliness of the discussions.

Secretariat refers Tuzla 7 State aid case to the Ministerial Council

On 26 June 2020, the Secretariat submitted a Reasoned Request to the Ministerial Council for a Decision under Article 91 of the Energy Community Treaty. The case (ECS-10/18) concerns compliance with the Energy Community State aid rules by a decision of the State Aid Council of Bosnia and Herzegovina of 23 July 2018, deciding that a guarantee issued by Federation of Bosnia and Herzegovina in favour of the Export-Import Bank of China to secure a loan to the public utility Elektroprivreda Bosne i Hercegovine does not constitute State aid within the meaning of Article 18(1)(c) of the Treaty.

The resolution of the renewables dispute in Ukraine – an update

At today’s session of the Verkhovna Rada of Ukraine, the Energy and Utilities Committee will review drafts aimed at implementing the Memorandum of Understanding developed in the mediation process under the Energy Community Dispute Resolution and Negotiation Centre. The signature of the Memorandum ending the dispute between two main associations of renewable investors and the Ukrainian Government on 10 June 2020 within the mediation process is an important achievement. It is now important to transpose correctly the Memorandum on terms agreed with the investors into a legislative act still before the summer break.

Secretariat welcomes Declaration of Federation of Bosnia and Herzegovina on Protection of Rivers banning new small hydropower plants

On 23 June, the Parliament of Federation of Bosnia and Herzegovina adopted a Declaration on the Protection of Rivers, as a response to several conflicts with local communities due to low-quality environmental impact assessments for existing small hydropower plants. Furthermore, the Parliament also adopted conclusions calling for a prohibition of the construction of small hydro power plants on the territory of Federation of Bosnia and Herzegovina.

EU4Energy launches project to support smart meter rollout in Moldova

On 23 June, the first stakeholder meeting to support Moldova in the development of a methodology for smart meter rollout took place under the framework of the EU4Energy project. Smart meters measure the exact use of energy by consumers and send the information automatically to the energy supplier. They allow consumers to better manage their energy use, save money and reduce emissions.

The Guidelines reflect the latest legal requirements stemming from the EU’s Clean Energy Package, soon to be adopted in the Energy Community. Their purpose it to provide advice to policy-makers in the Contracting Parties on the development of national legal and regulatory frameworks conducive to renewable self-consumption and empowering final customers to actively participate in the self-consumption of renewable energy.

Visit the Energy Community’s legislative observatory with more than 800 national legal documents

The legislative observatory of national secondary legislation has been updated to cover the latest legislative changes in all Contracting Parties.  The observatory now includes secondary gas and electricity legislation for all eight Contracting Parties that have transposed the Third Energy Package and lists all national bodies involved in the drafting and adoption of the legal acts. For the first time, it also covers climate change. In total, more than 800 secondary legal acts and other national documents have been assessed by the Secretariat.

Secretariat launches district heating and cooling network

Today, the Secretariat hosted a workshop dedicated to district heating. The workshop is the first event under the Secretariat’s new initiative to create a network to support efficient heating in the Energy Community. The network will prepare district heating companies for measures stemming from the EU Clean Energy for all European Package. The meeting gathered 50 stakeholders, including representatives of ministries, district heating companies, donors and international financial institutions to share their knowledge and experience with respect to the different challenges and opportunities linked to district heating system operation.

Ukraine to receive EU4Energy assistance in developing regulations needed for oil stocks reform

Secretariat unveils guidelines on natural gas distribution measurement

Today, the Secretariat published Policy Guidelines on measurement in the gas distribution network. The Guidelines, based on the relevant Energy Community acquis and best EU Member States practice, outline the legal basis for individual meters and smart metering and best practices with respect to the required unit conversions for measurement of gas delivery at the distribution level. They also cover billing and the customers’ right to access consumption and metering data.

Energy Community Advisory Committee amends its Rules of Procedure

The Advisory Committee has amended its Rules of Procedure by introducing a possibility to carry out public hearings as remote video proceedings under exceptional circumstances such as the current pandemic. This will enable parties to a dispute settlement case to present their arguments in front of the Advisory Committee as well as interested members of the public to participate remotely.

Gas distribution tariff in Ukraine risks unauthorized offtakes

A pending decision by the national energy regulator of Ukraine, NEURC, may withdraw an earlier decision to increase the gas distribution tariffs in Ukraine. Without distribution tariffs set at an adequate level, unauthorised offtakes of natural gas will persist, impairing the financial stability of the new transmission system operator and putting gas sector reforms at risk.

Contracting Parties improve technical, operational and communication standards to facilitate cross-border gas flows

The Secretariat published today an update of its 2019 report analysing the state of implementation of Regulation (EU) 2015/703 establishing a network code on interoperability and data exchange in the Energy Community Contracting Parties. Compliance in practice has improved. The number of concluded Interconnection Agreements as required by the Regulation significantly increased since the 2019 report. All three of the new agreements were concluded between Ukraine and EU Member States and reach a high level of compliance with the Regulation, especially with respect to measurement principles and data exchange rules.

Public consultation on Policy Guidelines on small hydropower plants: We want to hear from you!

The development of small hydropower projects in the Energy Community and its impact for instance on nature and biodiversity, population, human health, soil, water and landscape have been subject to growing public opposition and complaints to the Energy Community Secretariat. The overall purpose of the Policy Guidelines is to steer public authorities and project developers to ensure correct implementation of the acquis communautaire on environment and inform the general public about the legally obliged environmental assessment processes, public participation requirements and recourse possibilities.

ANRE and Moldovagaz ask the Secretariat’s Dispute Resolution and Negotiation Centre to facilitate discussions on costs associated with technical losses in gas distribution

The determination and recognition of costs associated with technical losses in the gas distribution tariffs has been an unresolved issue in the Moldovan gas sector for almost a decade. To resolve this issue, ANRE, the Moldovan regulator, and Moldovagaz, as holding company of the distribution companies in Moldova, requested the Centre to facilitate discussions on this matter and committed to make their best efforts to find a solution within a short time. Branislava Marsenic Maksimovic, gas expert in the Secretariat, will act as facilitator. All three parties have signed a Memorandum to that effect.

First virtual interconnection point of gas transmission capacity allocation in the history of the Energy Community established between Ukraine and Hungary

On 1 May, the Ukrainian and Hungarian gas transmission system operators, LLC and FGSZ, established the first virtual interconnection point “Bereg” on two interconnection points (Beregovo and Beregdaróc) according to the Capacity Allocation Mechanism (CAM) Network Code. This decision marks the first ever virtual interconnection point between a Contracting Party to the Energy Community and an EU Member State. It follows Ukraine’s decision to perform the first allocation of cross-border capacity on the border with Poland at the Polish GSA Platform Operator.

Energy Community Coordination Group assesses impact of COVID-19 on the renewables sector

Yesterday's Renewable Energy Coordination Group gathered more than 60 participants to discuss the impact of the COVID-19 crisis and other global trends on the renewables sector. As in the EU, the crisis has affected timelines for the implementation of ongoing renewables projects and postponed deadlines for bidding procedures (auctions) for new projects in the Energy Community. At present, Serbia is the only Contracting Party to have temporarily postponed the payment of support to privileged renewables producers during the state of emergency. The meeting highlighted that the promotion of renewable energy must be a strong component of recovery plans.

KOSTT-EMS energy dispute: Light at the end of the tunnel

After long negotiations facilitated by the European Network of Transmission System Operators for Electricity (ENTSO-E), a big step towards resolution of the dispute between the Kosovan transmission system operator KOSTT and the Serbian transmission system operator EMS came on 20 April 2020, when TSOs from Continental Europe voted positively for the draft Connection Agreement with KOSTT. This agreement, once signed and implemented, will end the long-lasting dispute between the two TSOs and give a boost to market integration in the Western Balkans and further with the rest of Europe.

Dispute about Restructuring Support Mechanism for Renewable Energy Projects in Ukraine: Statement by the Mediator

Concerns about exclusive contracts concluded by the incumbent power generator in Albania remedied

Electricity market players have approached the Secretariat regarding the existence of exclusive contracts concluded between the incumbent Albanian power generator, KESH and two traders. Based on these contracts, KESH engaged in peak/off-peak arbitrage. The contracts allowed the traders to off-take electricity from KESH during peak times (where the value of electricity is high) and return it to KESH during the off-peak times (where the value of electricity is low). This quantity-neutral exchange of qualitatively different products, in the absence of financial settlement to account for the difference in value, could have resulted in a significant value transfer from KESH to the traders.

Group of Observers takes note of temporary suspension of electricity procurement process in Moldova

The state-owned trader Energocom unilaterally entered into a contract with MGRES (ЗАО «Молдавская ГРЭС), a gas-fired power plant in the Trans-Dniester region.

Secretariat publishes detailed information on Ukraine’s large combustion plants under opt-out regime

Article 4(4) of the Large Combustion Plants Directive provides an implementation alternative for plants reaching the end of their lifetime. According to this regime (called limited lifetime derogation or opt-out), combustion plants can remain operational either until a certain number of operational hours or a given end date, whichever comes first. In exchange, they are exempted from compliance with the emission limit values of the Directive in this transitional period.

Today, the 5th Energy and Climate Committee meeting drew together more than 70 participants to discuss the Contracting Parties’ progress on the preparation of revised Nationally Determined Contributions (NDC2), ahead of COP26, and integrated National Energy and Climate Plans (NECPs). The European Commission also announced that a call for tender for a study aimed at extending the modelling capacities of the EU to the Contracting Parties for calculating 2030 overall targets was launched today, 25 March 2020, and will remain open until 20 May 2020. It also emphasized the link between NECPs and the Green Deal, focusing in particular on the Green Agenda for the Western Balkans.

Ukraine to be first Contracting Party to implement Gas Capacity Allocation Network Code

Last week, the Ukrainian gas transmission system operator LLC “Gas TSO of Ukraine” agreed with the Polish GSA Platform Operator to use the GSA Platform to allocate capacities on the interconnection points on the Ukraine-Poland border in line with the Gas Capacity Allocation Network Code and the ENTSOG capacity auction calendar. The first commercial auctions of the yearly products for gas year 2020/2021 will be conducted in July 2020.

Energy Community Coordination Group puts energy efficiency of buildings in the spotlight, unveils new biomass-based heating database

Improving the energy efficiency of buildings was at the core of the 22nd meeting of the Energy Community Coordination Group in Vienna on 11 March. The meeting took stock of the implementation of national building renovation strategies, as set out in the Group’s work programme 2019-2020, and ongoing and future investment programmes. This topic is expected to feature significantly in the next EU financial framework 2021-2027. With respect to the next energy efficiency issues to be tackled, it was agreed that the Group would prioritize working with municipalities on heating and cooling as well as nearly zero energy buildings. Stronger requirements for energy efficiency appliances and innovative funding programmes for residential buildings renovation would also be in focus. The national institutional, legal and regulatory frameworks governing the housing sector with an impact on energy investment will be assessed and improved.

EU4Energy supports Ukraine with transposition of energy infrastructure regulation

Secretariat meets new Kosovo Government, discusses future of energy reforms

The Secretariat met with representatives of the new Kosovo* Government, including Prime Minister Kurti, Deputy Prime Minister Abazi, Minister of Economy Hajdari and Minister of Infrastructure and Environment Abdixhiku, in Pristina on 3 March 2020. The meetings focused on issues related to the Kosova e Re project, replacing the existing renewables feed-in tariff support mechanism with a competitive mechanism and development of an integrated National Energy and Climate Plan. Ongoing infringement cases against Kosovo* were also discussed. The Secretariat was represented by Director Kopač, Deputy Director Buschle and Electricity Expert Kllokoqi.

Secretariat to cooperate with Ukraine’s Antimonopoly Committee regarding alleged abuse of dominance on Burshtyn island by DTEK

The Energy Community Secretariat has received a complaint regarding an abuse of dominance on Burshtyn Island by DTEK, Ukraine’s largest private electricity producer. Allegedly, DTEK is considerably cutting imports of electricity from Slovakia to Burshtyn Island by not utilizing the cross-border transmission capacities assigned to it. It thereby creates shortages of electricity available for sale on the day-ahead market, while at the same time offering more electricity on the balancing market, where prices are higher.

Director Kopač meets EU Commissioner for Neighbourhood and Enlargement

Today, the Director of the Energy Community Secretariat met with Olivér Várhelyi, the new EU Commissioner for Neighbourhood and Enlargement, in Brussels.  The meeting discussed opportunities for strengthening cooperation between the European Commission and the Energy Community Secretariat. It also focused on energy transition options for the Energy Community Contracting Parties, including in light of the upcoming EU-Western Balkans Summit taking place on 7 May in Zagreb under the auspices of the Croatian Presidency of the EU.

New study explores future system adequacy and capacity mechanisms in the Western Balkans

The electricity markets in the Western Balkans are experiencing a period of complex transition, characterised by the liberalization and decarbonisation agenda. Full integration into the EU internal energy market will require alignment with the European target model (e.g. reforms of the wholesale market and market coupling), European environmental regulation (e.g. implementation of Large Combustion Plants Directive, Industrial Emissions Directive and CO2 pricing, increased renewables penetration targets), and phasing out of existing non-compliant State aid. As a consequence, a number of plants could potentially retire, which raises security of supply concerns.

Montenegro continues to take major steps to reduce GHG emissions as government approves cap and trade system for major emitters

Following the adoption of the Law on Protection from the Negative Impacts of Climate Change in December 2019, Montenegro continues to lead the way in the Energy Community in the establishment of a complete system required to reduce greenhouse gas (GHG) emissions, protect the ozone layer and adapt to climate change. A new regulation on activities emitting GHG for which a GHG emission permit has been issued, adopted by the Government on 6 February and having entered into force on 21 February, brings Montenegro even closer to the EU acquis in the area of climate change. Its adoption was also one of the prerequisites for opening Chapter 27 of EU accession talks (on environment and climate change).

North Macedonia becomes first Contracting Party to start converting coal mines to solar fields

Moldova intensifies efforts to certify Moldelectrica, its TSO for electricity

Following the Secretariat’s Opinion on the certification of the electricity transmission system operator Moldelectrica, representatives of the Moldovan regulator (ANRE) and Moldelectrica met experts from the Secretariat to discuss options for unbundling. Secretariat calls on national State aid authorities to scrutinize subsidies to coal electricity production

In June 2019, the Energy Community Secretariat published a study on analysing and quantifying direct and hidden subsidies to support the coal sector in Bosnia and Herzegovina, Kosovo*, Montenegro, North Macedonia, Serbia and Ukraine during the period 2015-2017. The Secretariat sent a follow-up preliminary assessment of these subsidies under the Energy Community State aid acquis to the competent State aid authorities to further assess these measures as to their compatibility with the State aid acquis.

Secretariat launches study on carbon pricing design in the Energy Community

While the Energy Community Treaty works to integrate Contracting Parties into the EU energy market via harmonization of the legal and regulatory framework, a crucial element is still missing – a carbon pricing mechanism. EU electricity prices account for externalities via the emissions trading system (ETS), while the current Energy Community acquis does not include any such framework. A gradual alignment of the Energy Community carbon pricing policies with those of the EU would ensure a level playing field in the context of regional and pan-European market integration.

Secretariat opens dispute settlement procedure against Serbia for lack of adoption of a National Emission Reduction Plan

Today, the Secretariat sent an Opening Letter to Serbia to address the incomplete implementation of the Large Combustion Plants Directive. The Directive took effect on 1 January 2018 in the Energy Community. For existing large combustion plants, two alternative implementation avenues exist: either compliance with the emission limit values for SO2, NOx and dust at individual plant level, or implementation of a National Emission Reduction Plan (NERP). Every plant must be covered by either of the two options. Out of the sixteen existing large combustion plants in Serbia, nine are under the scope of the dispute settlement case.

Secretariat rejects choice of unbundling model of Gastrans

on 13 January 2020

Today, the Energy Community Secretariat published its Opinion on the Serbian regulator’s draft certification decision on Gastrans, the Serbian section of the TurkStream II pipeline system. In its Opinion, the Secretariat recalls that Gastrans has not been lawfully exempted from the unbundling provisions of the Gas Directive. The project does not enhance competition, as required for an exemption under Article 36 of the Gas Directive, but is detrimental to the development of competition on the Serbian market. By consequence, Gastrans is not eligible for a model of unbundling outside the Third Energy Package, as created by AERS, but can only be certified under the Gas Directive’s provisions on ownership unbundling.

Secretariat opens dispute settlement procedure against Kosovo for illegal State aid to Kosovo e Re

On 20 December 2019, the Secretariat sent an Opening Letter to Kosovo* in Case ECS-4/19,  addressing its concerns with regard to the illegality and existence of State aid in relation to the Kosovo e Re project. In particular, the Secretariat preliminarily found that certain measures, such as energy and availability payments over 20 years under the power purchase agreement, the sale and transfer of the plant site under market value, a state guarantee, a VAT exemption, and taking over several charges and costs constitute State aid.

The Secretariat supports certification of the gas transmission system operator of Ukraine

By an Opinion adopted today under the Third Energy Package, the Secretariat confirmed that the newly established gas transmission system operator of Ukraine, GTSO, is unbundled in line with the requirements from European law. Unbundling had been suffering from internal disputes and inertia for many years. Today’s  positive Opinion is essentially the consequence of the recent adoption of a Law on Unbundling by Verkhovna Rada. On the basis of this Law, the vertically integrated Naftogaz group transferred the shares in GTSO to MGU, a holding company controlled by the Ministry of Finance. The Ministry of Finance also equipped GTSO with so-called economic management rights over the transmission assets, which enable the company to use and operate the state-owned system. As a consequence of these transactions, GTSO will operate as an independent system operator (ISO) as from 1 January 2020.

Ukraine and Moldova sign Memorandum of Understanding on Cooperation in the Area of Security of Gas Supply

Today, the High-level Policy Talks on gas security of supply and cooperation, organized under the auspices of the EU4Energy Governance Project*, took place in Chisinau. Back to back with the 17th meeting of the Energy Community Ministerial Council, Moldova and Ukraine signed a Memorandum of Understanding on the Cooperation in the Area of Security of Gas Supply as a result of Energy Community and EU4Energy efforts to strengthen energy security in the region. The Memorandum was signed by Mr Anatol Usatîi, Minister of Economy and Infrastructure of the Republic of Moldova and Mr Kostiantyn Chyzhyk, Deputy Minister of Energy and Environmental Protection of Ukraine.

WB6 regional electricity market integration reached point of no return

The WB6 regional electricity connectivity closing event brought together 80 stakeholders from all WB6 Contracting Parties on 5 December in Tivat, Montenegro. The project successfully delivered 11 national, one bilateral and five regional projects, which were instrumental in tackling some of the biggest challenges the WB6 were facing in creating a regional electricity market. The participants agreed that the creation of the regional market was now at the point of no return. Its continuation is critical to meeting the region’s energy priorities - ensuring security of supply and meeting decarbonisation objectives.

Study uncovers potential cyber threats to critical energy infrastructure

Following one year of research and analysis, the final cybersecurity study on the energy sector in the Energy Community was presented at the cybersecurity workshop on 10 December in the Secretariat’s premises in Vienna. The main problem identified is the generally weak or missing focus on the energy sector in national cybersecurity strategies and implemented legislation. This is of particular concern as the energy sector requires specific communication and operation technologies, critical timescales and sensitivity to cascading effects.

Negotiations about state guarantee for the Tuzla 7 project end without agreement

The Secretariat and representatives of the Federation of Bosnia and Herzegovina yesterday terminated their negotiations related to the planned coal-fired power plant Tuzla 7 without having reached an agreement. The negotiations became futile after the Federal Minister of Finance on 19 November 2019 signed a guarantee agreement without prior clarification of compliance with Energy Community State aid rules.

Energy Community Regulatory Board Work Programme 2020: ECRB to extend international regulatory cooperation under direction of new President

At its meeting on 4 December 2019 in Athens, the Energy Community Regulatory Board (ECRB) adopted its work programme for 2020. Among others, it foresees the further strengthening of international cooperation with MEDREG and CEER regulators based on a Cooperation Arrangement signed by the three regional regulatory institutions in December 2018. In this context, ECRB welcomed the involvement of the Energy Regulatory Agency of Azerbaijan in ECRB, which participated in Plenary discussions for the first time. It was also agreed to further tighten cooperation with the gas regulatory authority of Egypt.

Secretariat launches training for Contracting Party national judges

National judges of the Contracting Parties are barely informed about the existence of the Energy Community and are not used to applying Energy Community law. However, the relevance of Energy Community law for national court judges of the Contracting Parties is increasingly growing. In order to boost their awareness and knowledge of EU / Energy Community law in the areas of energy, environment and beyond, the Secretariat held today the first training of national judges in North Macedonia. The training gathered judges from primary courts, appellate courts, the administrative court as well as the constitutional court. In the future, the Secretariat may conduct trainings in other Contracting Parties as well.

Energy Community discusses new timeframe for 2030 targets

At today’s meeting of the Energy and Climate Technical Working Group, the European Commission announced a new timeframe for setting 2030 targets for energy efficiency, renewables and greenhouse gas emission reduction within the Energy Community. The targets are now expected to be adopted by mid-2021. Even before having the Energy Community targets in place, several Contracting Parties showed their determination to move ahead with 2030 energy and climate planning in the imminent future based on their own targets.

Ukrainian Parliament creates basis for unbundling the gas transmission system operator

By adopting a Law on amending several legal acts for the purpose of unbundling the gas transmission system on 15 November, the Verkhovna Rada of Ukraine created the necessary conditions for establishing an independent system operator (ISO) for gas in line with the Third Energy Package applicable under the Energy Community Treaty. Following years of inertia and political infighting, the adoption of the Law removes one of the main obstacles to compliance in the country’s gas sector and for the continuation of long-term gas transits from Russia.

The clock is ticking: Coal-fired power plants struggle to meet emissions standards, reveals Annual Implementation Report

The Energy Community Secretariat’s Annual Implementation Report published today shows that all Contracting Parties which have coal in their energy mix are not in compliance with the emission ceilings established under their National Emission Reduction Plans (NERPs) for at least one of the three pollutants (nitrogen oxides, sulphur dioxide and dust) of the Large Combustion Plants Directive. Kosovo* failed to comply with the ceilings for all three, while Bosnia and Herzegovina and North Macedonia both failed to reach the ceilings for sulphur dioxide and dust. Ukraine’s 67 plants falling under the NERP narrowly met the emission ceilings this year, while Moldova failed to report its annual emissions of 2018. Given the lack of adoption of the NERP in Serbia, large combustion plants have to comply with the emission limit values of the Directive on an individual basis. For the majority of Serbia’s plants, this is not yet the case with emissions of sulphur dioxide being particularly worrisome.

North Macedonia prepares first strategy in line with integrated national energy and climate plans

On 11 November 2019, North Macedonia presented to the Secretariat the final draft of its Energy Strategy 2040, including with the perspective till 2030, which is the first to follow the overall structure of national energy and climate plans (NECPs) in the Energy Community and the timeframe indicated by the related Ministerial Council Recommendation. It covers the five dimensions of the Energy Union, although merging integration and security of energy markets and including an additional dimension on legal and regulatory aspects. The strategy sets out three scenarios, of which the intensive renewables one (green scenario) proved to be the most cost-effective. It incorporates also results from the study on 2030 targets, which the Secretariat launched in 2018 and was finalised earlier this year.

EU4Energy steers implementation of smart metering in Ukraine

On 7 November, the first stakeholder meeting to launch support for the development of a methodology for smart meter rollout in Ukraine took place under the framework of the EU4Energy project. Smart meters measure the exact use of energy (i.e. gas and electricity) by consumers and send the information automatically to the energy supplier, giving the possibility to better manage energy use, save money and reduce emissions.

Energy Community VAT project group embarks on harmonizing taxes on cross-border energy sector transactions

Differences in value added tax (VAT) are a critical barrier to cross-border trade in electricity and gas. This is the reason why the Energy Community Secretariat with the assistance of DG TAXUD, European Commission, initiated efforts to synchronise VAT regimes across the Contracting Parties. The basis for this work is the EU VAT Directive. Its full implementation is also a precondition for market coupling, starting with the first projects between Bulgaria and North Macedonia and 4 MMC with Serbia.  A platform of VAT experts, primarily consisting of representatives of Ministries of Finance, was created to lead this process.

EU4ENERGY meeting maps out how to improve settlement of cross-border unintentional deviations between Ukraine and Moldova

On 29 October, Energy Community Secretariat experts led a workshop in Kyiv, addressing the key mechanisms for future management of unintentional deviations between power systems of Ukraine and Moldova. Representatives of the national regulatory authorities and transmission system operators from Moldova and Ukraine engaged in an active discussion on the regulatory requirements for the settlement of the unintended exchanges in line with current practice in EU Member States and discussed approaches in designing the arrangements for settlement of unintentional deviations between power systems. Furthermore, the model of the new ENTSO-E methodology for Continental Europe on the common settlement rules for all unintended exchanges of energy was presented.

Secretariat concerned about draft amendments to the Electricity Market Law in Ukraine

A recent draft promoted by members of the Verkhovna Rada, the Parliament of Ukraine, envisages that in the future the government may prohibit or restrict electricity exports and imports, and imposes strict price caps on the wholesale market. It also excludes large renewable power installations above a capacity of 150 MW from priority dispatch, and allows for curtailment without compensation for these installations. The proposed changes are likely to breach Energy Community rules. The draft passed already the Rada’s committee on energy on Friday last week.

Georgia to receive assistance in developing new standard terms and conditions for electricity contracts

Energy Community Secretariat and the Agency for the Cooperation of Energy Regulators upgrade cooperation

Today’s signature of an amendment to the Administrative Arrangement concluded between the Secretariat and the European Union Agency for Cooperation of Energy Regulators, ACER, in 2016 marks the starting point for further enhanced cooperation between the two institutions. The amendment grants the Secretariat the possibility to participate in the Market Integrity and Transparency Working Group of ACER. This will allow the Secretariat to closely follow EU regulators’ discussions on the REMIT Regulation and, by this, support the Energy Community Contracting Parties’ regulators to implement the REMIT Regulation aligned with EU developments. The amended Administrative Arrangement comes in time with the obligation of Contracting Parties to transpose the REMIT Regulation by end of November 2019.

2019 Gas Forum focuses on new gas infrastructure, innovative use of gas and future structure of supply routes

Taking place on 24 and 25 September in Ljubljana, the 14th Energy Community Gas Forum discussed regional gas markets and infrastructure, deploring inter alia the missed opportunity to bring the Serbian Gastrans exemption in line with European standards. On the table was also the future role of gas and innovation in the gas supply chain which will open up potential new uses of gas and related infrastructure in a sustainable manner. The Gas Forum endorsed actions aiming at adoption of the Clean Energy Package in the Energy Community.  “These will help us to work more efficiently with Contracting Parties especially from the perspective of security of supply,’’ explained Director of the Energy Community Secretariat Kopač. Among others, the Gas Forum discussed  the needed amendments to the Treaty establishing the Energy Community in order to make the organization more efficient.

Energy Community gas emergency exercise highlights need for coordination

The Energy Community Secretariat organized the first ever gas emergency exercise on 23 September 2019 in Ljubljana. The competent authorities, transmission system operators and gas undertakings of the Contracting Parties along with Greek representatives had to decide which internal emergency measures they would put in place in case of a prescribed gas disruption scenario. In addition, the exercise represented the first occasion when Contracting Parties had to plan and simulate how they would cooperate and exchange information with their direct neighbours, the Energy Community Secretariat and other countries such as EU Member States along the gas transport route.

EU4Energy to assist Moldova and Ukraine in improving cross-border trade mechanisms

Workshop highlights lack of focus on energy and regional cooperation in Contracting Parties’ cybersecurity strategies

A workshop on cybersecurity in the energy sector was hosted by the Secretariat on 17 September 2019 in Vienna.  The workshop, which brought together more than forty participants from the ministries, regulatory bodies and operators of critical electricity and gas infrastructures across the Energy Community, was dedicated to presenting the preliminary results of a study on cybersecurity.

High-Level Policy Talk on "Coal Regions in Transition and the Energy Community”

EU4Energy to support development of new electricity procurement procedures in Moldova

On 9 September, the first stakeholder meeting to launch support for the update of the current electricity procurement procedures in Moldova took place in Chisinau. Until the end of the year, Energy Community Secretariat experts, representatives of the National Agency for Energy Regulation of the Republic of Moldova (ANRE) and other stakeholders (Moldelectrica, distribution system operators, suppliers) will work together to review the regulatory framework and draft new procurement procedures and framework contracts in order to establish an efficient process for electricity procurement in Moldova. Furthermore, an assessment and specifications of an efficient electronic process for electricity procurement will be prepared.

Cycling duo arrives in Kraków after 3,5 days journey

The Energy Community cycling duo arrived safely in Kraków on Thursday at 13:05pm after a 460-kilometre journey through Austria, Slovakia and Poland accomplished in three and a half days. Each cyclist saved 120.3 kgs of CO2 emissions compared to going by plane. The journey was closely followed on facebook by the 40 participants of the Energy Community Summer School who gave the cyclists a warm welcome upon arrival.

Director Kopač attends the inaugural session of the new Ukrainian Parliament

Today marked the inaugural session of the new Ukrainian Parliament, Verkhovna Rada. The Director of the Secretariat, Mr Janez Kopač, was honoured to attend the session as a special guest, together with the Vice President of the European Parliament, Ms Klara Dobrev, the President of the OSCE Parliamentary Assembly, Mr George Tsereteli, and the four former Ukrainian Presidents: Mr Kravchyk, Mr Kuchma, Mr Yuschenko and Mr Poroshenko. Dismissing the old Government, the new 424-member Parliament appointed Mr Alexey Goncharuk as the new Prime Minister. It also selected a new speaker and committees.

Energy Community duo cycles 460 km to this year’s Summer School to underscore importance of decarbonisation and sustainability

The clean energy transition is at the heart of the Energy Community’s activities and constitutes the key focus of this year’s Energy Community Summer School taking place on 24-31 August in Kraków, Poland. In order to reduce the carbon footprint of the event and demonstrate the importance of taking ambitious actions to mitigate climate change, a small team of experts of the Energy Community Secretariat left the Vienna premises early today for a 460-kilometre journey through Austria, Slovakia and Poland.
