Secretariat provides compliance assessment of the Ukrainian electricity TSO Ukrenergo with the unbundling requirements of Directive 2009/72/EC

In response to request of the European Network of Transmission System Operators for Electricity (ENTSO-E) the Energy Community Secretariat conducted a status review of the compliance by the Ukrainian electricity TSO Ukrenergo with the unbundling requirements of Directive 2009/72/EC. The assessment is prepared in the context of Ukrenergo’s prospects to become a member of ENTSO-E.

In 2021, Ukrenergo was conditionally certified under the ISO model by the National Energy and Utilities Regulatory Commission (NEURC), considering the Secretariat’s Opinion 04/21 on the preliminary certification of Ukrenergo with several concerns related, inter alia, to the independence of Ukrenergo.

In the Secretariat’s assessment, Ukrenergo has been diligently implementing the requirements from unbundling and certification. At the same time, the Secretariat notes some issues pertaining to the sphere of the Ministry of Energy controlling the TSO which require further action to ensure compliance.
