Secretariat discontinues case against Kosovo* for lack of State aid enforcement

Today, the Energy Community Secretariat decided to discontinue its oldest pending case which it opened against Kosovo* because of the lack of transposition and implementation of the State aid acquis.

In 2011, Kosovo* adopted the Law on State aid (revised in 2016) which transposes the State aid acquis. At the end of last year, the State Aid Commission rendered its first decision concerning State aid in the energy sectors. It found that an administratively set feed-in-tariff for 20 MW of photovoltaic projects does not comply with the State aid acquis.

* This designation is without prejudice to positions on status, and is in line with UNSCR 1244 and the ICJ Opinion on the Kosovo declaration of independence.
