Ukraine’s regulator submits new preliminary decision on certification of electricity transmission operator to the Secretariat
On Friday, 1 October 2021, the National Energy and Utilities Regulatory Commission of Ukraine (NEURC) adopted a new Preliminary Decision on certification of the Ukrainian Transmission System Operator for electricity – Joint Stock Company National Power Company Ukrenergo, and invalidated the Preliminary Decision adopted on 2 June 2021. NEURC preliminarily certified Ukrenergo under the independent system operator (ISO) model of unbundling.
The new Preliminary Decision follows the transfer of ownership of both the transmission assets and the shares of Ukrenergo from the Ministry of Finance to the Ministry of Energy, by which Ukrenergo has been placed under control of a new public body, the Ministry of Energy.
Pursuant to Article 10 of Directive 2009/72/EC and Article 3 of Regulation (EC) No 714/2009, the Secretariat shall examine the notified Preliminary Decision and deliver its Opinion to NEURC as to the compatibility of such a decision with Article 9(8) and Article 13 of the Electricity Directive. NEURC is to adopt a final certification decision, taking the utmost account of the Secretariat’s Opinion.
