Ministerial Council decides on failure of Serbia to grant non-discriminatory access to the Horgoš gas entry point
Last week, the Ministerial Council of the Energy Community rendered its decision on the failure of Serbia to comply with its obligations under the Treaty in Case ECS-13/17. The Ministerial Council decided that the discriminatory terms for granting third party access and capacity allocation by the Serbian gas incumbent Srbijagas, on the gas interconnector with Hungary at Horgoš infringes the Third Energy Package’s Gas Directive and Regulation. By consequence, Serbia failed to comply with its obligations under the Energy Community Treaty.
With this Decision, the Ministerial Council upheld the Reasoned Request submitted by the Secretariat and followed the opinion of the Advisory Committee.
