The EU4Energy Governance Project spanned for four years from June 2016 to June 2020. Within the project, the Energy Community Secretariat delivered technical assistance to three Eastern Partnership countries, Georgia, Moldova and Ukraine, that also are members of the Energy Community. Regional activities of the project also involved Armenia, Azerbaijan and Belarus.

EU4Energy also works on a regional level to help to identify key regional energy infrastructure projects (not covered by the PECI/PMI process) that contribute to enhanced transmission of energy in the Eastern Partnership geographic area - Projects of Eastern Partnership Interest (PEPIs).
As a first step, the EU4Energy Governance team developed a methodology for identification of Projects of Eastern Partnership Interest. The methodology covers projects of cross-border relevance in Eastern Partner Countries, which are not members of the Energy Community (Armenia, Azerbaijan and Belarus), and projects connecting Energy Community Contracting Parties with Eastern Partner Countries (i.e. Ukraine with Belarus and Georgia with Armenia). While derived from Regulation 347/2013 on guidelines for trans-European energy infrastructure, the PEPI methodology was adapted to fit the specific circumstances and needs of these countries. The developed Methodology is for internal use only.
On this basis, the countries were requested to voluntarily submit their priority projects for evaluation. The preliminary assessment of energy infrastructure priority investment opportunities in the Eastern Partnership countries was carried out by the EU4Energy and Energy Community Secretariat teams. This assessment applied cost benefit analysis (CBA) methodology, and assessed the projects based on their contribution to market integration and price convergence; security of gas supply; contribution to enhanced competition; and sustainability including CO2 savings. The purpose of having this assessment is to help project promoters and governments to allocate resources to those cross-border projects that are assessed to be the most beneficial in socio-economic terms and to take informed decision in developing these projects further.
The results of the preliminary assessment (being a laboratory exercise) were shared with stakeholders across the Eastern Partner countries at a workshop that took place on 10 April 2019.
Five projects were assessed in the electricity sector (three transmission lines under the Black Sea linking Georgia with EU Member States and two sections of a transmission line connecting Belarus and Ukraine and two in gas sector (White Stream gas pipeline and bi-directional operation of two interconnection points on the Ukrainian-Belarus border).
Based on the assessment results, an indicative list of energy infrastructure priority investments (PEPIs) was developed and included into the Report “Assessing Energy Infrastructure Projects for EaP countries”. The mentioned Report is subject to further assessment by the contracting authority, the European Commission.

EU4Energy also works on a regional level to help to identify key regional energy infrastructure projects (not covered by the PECI/PMI process) that contribute to enhanced transmission of energy in the Eastern Partnership geographic area - Projects of Eastern Partnership Interest (PEPIs).
As a first step, the EU4Energy Governance team developed a methodology for identification of Projects of Eastern Partnership Interest. The methodology covers projects of cross-border relevance in Eastern Partner Countries, which are not members of the Energy Community (Armenia, Azerbaijan and Belarus), and projects connecting Energy Community Contracting Parties with Eastern Partner Countries (i.e. Ukraine with Belarus and Georgia with Armenia). While derived from Regulation 347/2013 on guidelines for trans-European energy infrastructure, the PEPI methodology was adapted to fit the specific circumstances and needs of these countries. The developed Methodology is for internal use only.
On this basis, the countries were requested to voluntarily submit their priority projects for evaluation. The preliminary assessment of energy infrastructure priority investment opportunities in the Eastern Partnership countries was carried out by the EU4Energy and Energy Community Secretariat teams. This assessment applied cost benefit analysis (CBA) methodology, and assessed the projects based on their contribution to market integration and price convergence; security of gas supply; contribution to enhanced competition; and sustainability including CO2 savings. The purpose of having this assessment is to help project promoters and governments to allocate resources to those cross-border projects that are assessed to be the most beneficial in socio-economic terms and to take informed decision in developing these projects further.
The results of the preliminary assessment (being a laboratory exercise) were shared with stakeholders across the Eastern Partner countries at a workshop that took place on 10 April 2019.
Five projects were assessed in the electricity sector (three transmission lines under the Black Sea linking Georgia with EU Member States and two sections of a transmission line connecting Belarus and Ukraine and two in gas sector (White Stream gas pipeline and bi-directional operation of two interconnection points on the Ukrainian-Belarus border).
Based on the assessment results, an indicative list of energy infrastructure priority investments (PEPIs) was developed and included into the Report “Assessing Energy Infrastructure Projects for EaP countries”. The mentioned Report is subject to further assessment by the contracting authority, the European Commission.

Regional infrastructure projects
EU4Energy worked on a regional level to help to identify key regional energy infrastructure projects (not covered by the PECI/PMI process) that contribute to enhanced transmission of energy in the Eastern Partnership geographic area - Projects of Eastern Partnership Interest (PEPIs).
As a first step, the EU4Energy Governance team developed a methodology for identification of Projects of Eastern Partnership Interest. The methodology covered projects of cross-border relevance in Eastern Partner Countries, which are not members of the Energy Community (Armenia, Azerbaijan and Belarus), and projects connecting Energy Community Contracting Parties with Eastern Partner Countries (i.e. Ukraine with Belarus and Georgia with Armenia). While derived from Regulation 347/2013 on guidelines for trans-European energy infrastructure, the PEPI methodology was adapted to fit the specific circumstances and needs of these countries. The developed Methodology was for internal use only.
On this basis, the countries were requested to voluntarily submit their priority projects for evaluation. The preliminary assessment of energy infrastructure priority investment opportunities in the Eastern Partnership countries was carried out by the EU4Energy and Energy Community Secretariat teams. This assessment applied cost benefit analysis methodology, and assessed the projects based on their contribution to market integration and price convergence; security of gas supply; contribution to enhanced competition; and sustainability including CO2 savings. The purpose of having this assessment was to help project promoters and governments to allocate resources to those cross-border projects that were assessed to be the most beneficial in socio-economic terms and to take informed decision in developing these projects further.
The results of the preliminary assessment (being a laboratory exercise) were shared with stakeholders across the Eastern Partner countries at a workshop that took place on 10 April 2019.
Five projects were assessed in the electricity sector (three transmission lines under the Black Sea linking Georgia with EU Member States and two sections of a transmission line connecting Belarus and Ukraine and two in gas sector (White Stream gas pipeline and bi-directional operation of two interconnection points on the Ukrainian-Belarus border).
Based on the assessment results, an indicative list of energy infrastructure priority investments (PEPIs) was developed and included into the Report “Assessing Energy Infrastructure Projects for EaP countries”.

The focus of EU4Energy support in the area of energy efficiency was in the buildings sector. The EU4Energy Governance team assisted Georgia in developing the appropriate legal framework for energy efficiency in buildings. In particular, the draft law on energy performance in buildings was developed, transposing Directive 2010/31/EU by introducing minimum energy performance requirements for buildings and energy performance certification of buildings and apartments. The draft law was adopted by the country’s Parliament.
In parallel, the EU4Energy Governance team also provided support in drafting the secondary legislation for the certification of energy performance in buildings. A dedicated Working Group developed national regulations on the certification of the energy performance of buildings. It also revised a template for the energy performance certificate.
Assistance was also provided to Georgia in developing two important Regulations. The first Regulation was on the inspection of heating systems, while the second focused on the inspection of air conditioning systems. Both were delivered as one legal act in March 2020.

As part of Georgia’s efforts in reforming its wholesale electricity market, the EU4Energy Governance project team provided assistance in drafting the necessary secondary legislation to support the implementation of the Law on Energy and Water Supply, adopted in December 2019.
The following legislation was developed: a comprehensive set of licensing conditions; rules for supply of universal services and supplier of the last resort; procedure on the development, submission and publication of DSO compliance programme; rules for cross-border capacity allocation, and rules on security of electricity supply.
Rules for the day-ahead and intraday market were also developed with EU4Energy support.
Under the 2019 – 2020 work programme, we helped with the development of a regulation to protect vulnerable customers in the electricity sector. We also assisted in devising standard terms and conditions for direct contracts on the sale and purchase of electricity.

The EU4Energy Governance project team assisted Georgia in drafting secondary legislation for gas market reform. Several pieces of secondary legislation were prepared: Natural Gas Distribution System Code; Natural Gas Transmission Tariff Methodology; and Natural Gas Storage Tariff Methodology. Assistance in developing Gas Market Rules was also provided.
The draft Natural Gas Distribution Network Code was developed to elaborate the terms and conditions for operation as well as the management and functioning of natural gas distribution networks in Georgia. This code contributed to opening up the gas market, attracting investment and providing an improved security of gas supply in Georgia.
In close cooperation with Georgian authorities, the update of Georgia’s natural gas transmission tariff methodology was finalised. This potentially makes Georgia a forerunner among contracting parties in bringing its legislation in line with the network code on harmonised tariff structures. The establishment of an entry-exit gas transmission tariff methodology is part of the natural gas market reform that was being carried out by Georgia as part of its commitments under the Energy Community Treaty.
Beyond this, the EU4Energy team worked with the Georgian regulatory authority to devise a natural gas storage tariff methodology. Georgia’s plans for building an underground gas storage facility to cater for security of supply and market opening necessitate the establishment of rules for charging for the storage services.
In 2020, the team helped the country develop a regulation on protecting vulnerable consumers in the natural gas sector.

The EU4Energy Governance team drafted legislation on sampling and analysis of marine fuel to improve the quality of fuels used by vessels. In November 2017, the final draft legislation transposing the full set of provisions of Directive 1999/32/EC was delivered to the Ministry of Environment and Natural Resources Protection of Georgia and later adopted. The document focused on fuel quality monitoring plans as well as sampling and analysis of marine fuels used by vessels navigating through inland maritime and territorial waters. From 1 January 2019, the sulphur content of the marine fuel being used on board will be checked in at least 30% of the inspected ships.

In February 2018, Moldova took a big step in adopting the new Law on Energy Efficiency that was prepared with EU4Energy technical assistance. The law is now in compliance with the Directive 2012/27/EU and brings multiple benefits to the country.
Support was also provided in finalising full compliance of the Law on Energy Performance of Buildings with Directive 2010/31/EU. This was achieved by developing a building certification system, including a certification calculation tool.
As a first step, a comprehensive gap assessment of the technical, legal and organisational framework conditions was undertaken which was necessary to make the legal framework fully compliant with Directive 2010/31/EU on the energy performance of buildings. The gap analysis on the existing legal framework for the calculation of energy performance of buildings resulted in a roadmap for the roll-out of the energy performance calculation software.
Building on assistance in this area, the EU4Energy Governance project developed the missing parts of the Excel-based tool for the calculation of energy performance of buildings, which was subsequently presented to the relevant authorities in Moldova. The aim of this tool is to provide information on energy consumption of buildings and apartments. It also offers recommendations on energy performance improvements to lower energy consumption and costs. The tool takes into account different climatic zones, automatic calculation of U-values for windows and walls, and considers renewables for issuing the energy performance certificates of buildings.
EU4Energy provided support in the development of the Monitoring and Verification Platform for the National Energy Efficiency Action Plan (NEEAP) and the development of a long-term strategy for mobilising investment in renovation of the national stock of buildings (Article 4 of Directive 2012/27/EU).

A key area of EU4Energy support was the development of a new market concept design for the operation of the wholesale electricity market including detailed market rules as well as rules for cross-border capacity allocation. The design addressed market and technical-oriented parameters and possibilities to couple with neighbouring countries’ markets. Special emphasis was given to the creation of a separate balancing market combined with a reserves market and the application of rules that will count and charge imbalances to market participants.
Support was also provided for the development of a tariff calculation methodology for the electricity market operator of Moldova. Both financing and tariff models were thoroughly reviewed and scrutinised through an open consultation process with the representatives of the working group led by the National Energy Regulatory of Moldova (ANRE) and the Energy Community Secretariat.
Another key area of EU4Energy support was the preparation of the Wholesale Electricity Market Rules. The new rules included rules for the forward market, the day-ahead and intraday markets, the balancing market, ancillary services procurement and imbalance settlement.
EU4Energy also provided support in transposition and implementation of EU network codes (requirement for grid connection of generators (RfG), requirements for grid connection of high-voltage direct current system and direct current-connected power park modules (HVDC), network code on demand connection (DCC)) as part of the electricity market reform. There was also EU4Energy support for the regional cross-border balancing between Moldova and Ukraine and facilitating Transmission System Operators’ arrangements for scheduling, matching and settlement of deviations through development of draft corresponding legal acts. A high-level policy talk with both Moldovan and Ukrainian officials was held in July 2018 and in June 2019.
Among the achievements in the work programme of 2019 - 2020, various legal acts were drafted related to scheduling, matching and settlement of the deviations between Moldova, Ukraine and various TSOs. In addition, the team helped set out rules and procedures for electricity procurement.

The EU4Energy Governance project supported Moldova in two key areas of its natural gas market reform: development of the methodology for gas tariff calculations and drafting of legal acts related to gas transmission and distribution codes.
The project helped to develop the methodology for establishing the entry-exit gas transmission tariff which was part of the country's natural gas market reform, which was in line with its commitments under the Energy Community Treaty. Transparent tariff calculations contribute to the opening of the Moldovan gas market, promote investments in gas infrastructure and enhance the country’s security of gas supply.
EU4Energy also worked with Moldovan authorities and prepared two draft legal acts establishing the terms and conditions for the operation and management of natural gas transmission and distribution networks, as part of the natural gas market reform.

The EU4Energy Governance project supported the transposition and implementation of legislation related to reducing emissions into the air from large combustion plants. Regulating emissions from large combustion plants helps to reduce air pollution and safeguard the health and well-being of citizens. The EU4Energy Governance project provided technical assistance to support transposition and implementation of Directive 2001/80/EC on the emissions of certain pollutants into the air from large combustion plants.

With the support of the EU4Energy Governance project, Ukraine made significant progress in promoting energy efficiency with the setting of national energy efficiency targets, the preparation of the National Energy Efficiency Action Plan, and the Energy Performance of Buildings Law.
Starting with the support in developing national energy efficiency targets for 2020 and 2030, the EU4Energy Governance project team carried out a scenario modelling to determine the potential for energy savings across economic sectors. On this basis, the national energy efficiency targets were calculated and a draft Governmental Decree was prepared for the adoption of the targets.
To achieve the targets set, the EU4Energy team supported the preparation of the draft National Energy Efficiency Action Plan (NEEAP) for 2019 -2030 and a roadmap for its implementation. The NEEAP is a strategic policy document that sets the country’s overall and intermediate national indicative energy savings targets for the public and private sectors and proposes concrete measures and actions to meet these targets. This work was important as Ukraine relied on the Law on Energy Conservation adopted in 1994 as the main legal act on energy efficiency.
Another important achievement was the support provided by the EU4Energy Governance project to develop the amendments to draft Energy Performance of Buildings Law resulted in its adoption by the Ukrainian Parliament in 2017. The Law transposed certain provisions of the Directive 2010/31/EU and introduced application of obligatory minimum energy performance requirements for new constructed buildings, reconstruction of buildings and major repairs of buildings. Certification of new buildings is mandatory.
With the assistance of the EU4Energy Governance project, Ukraine prepared a strategy and roadmap for mobilizing investments to renovate and upgrade existing buildings so they are more energy efficient. The strategy describes the policies and measures required to assist building and home-owners to implement energy efficiency technologies.

The EU4Energy Governance project provided support to Ukrainian authorities with the transition to the new electricity market model and in reforming its wholesale electricity market in accordance with the Energy Community acquis. The Law of Ukraine “On Electricity Market” entered into force in June 2017 and saw the “single-buyer” market model being replaced with a wholesale market scheme compliant with the Third Energy Package. The law envisaged a two-year transitional period, and full compliance of the electricity market was expected to be achieved by 1 July 2019.
With the support of the EU4Energy Governance project, the main secondary legislation was developed in 2018 (market rules, day-ahead market / intraday market rules, retail market rules). The procedure for purchase of electricity at a “green” tariff was subsequently approved in 2019.
The EU4Energy Governance project also provided support in developing two key methodologies for implementing the provisions of Electricity Market Law in line with the provisions of the Third Energy Package:
- methodology for available cross-border capacity calculation
- the regulatory methodology for ancillary services
The adopted methodology for cross-border capacity calculation ensures efficient cross-border trading and effective integration of the electricity markets. In addition, the methodology for calculating tariffs for ancillary services, such as voltage control and black start (upon implementation) ensures the efficient cost allocation in the procurement of ancillary services and the effective functioning of the electricity market. Both methodologies were presented in the last quarter of 2018 to the National Energy and Utilities Regulatory Commission (NEURC) and the state-enterprise NPC Ukrenergo.
Various other regulatory acts to ensure compliance with guidelines on inter-transmission system operator compensation mechanisms and transmission charging were developed. The EU4Energy Governance project assisted Ukraine in preparing the draft Law on Unbundling of the state-owned gas monopoly Naftogaz and provided support in drafting secondary legislation for the country's gas market reform.
The draft Law on Unbundling of the state-owned gas operator was presented to the Ukrainian authorities in June 2017. The unbundling of the gas supply was to ultimately lead to increased competition, diversification of energy resources, safeguarding of supply and decreased prices for consumers.
EU4Energy support in 2018/2019, saw the preparation of methodologies and indicators to support the drafting of secondary legislation related to the indicators for the monitoring of the quality of gas distribution and supply services and the methodology for gas distribution tariffs.
The EU4Energy Governance project updated the methodology for calculating gas distribution tariffs in Ukraine. This methodology was compliant with the Third Energy Package Gas Directive 2009/73/EC, and included a calculation tool and action plan for its implementation. The updated methodology was to result in a better cost recovery, transparency, tariff design and regulatory stability.
Finally, both a concept and specifications requirements to develop an IT platform for NEURC to collect gas related data were delivered in August 2019.

The EU4Energy Governance helped to tackle emissions caused by incineration and co-incineration of waste in Ukraine. In cooperation with the Ministry of Environment and Natural Resources of Ukraine, the EU4Energy Governance project helped develop secondary legislation.
In February 2019, the team presented the draft of new technical standards of emissions for plants incinerating or co-incinerating waste. As set out in Directive 2010/75/EU, the draft secondary legislation regulates emissions of plants disposing waste or using waste as a fuel by setting emission limit values and continuous monitoring measures.
