The subject matter of this case is the non-compliance caused by the lack of adoption of the National Emission Reduction Plan (NERP) in Serbia. The Secretariat preliminarily concluded that in the absence of an adopted NERP, large combustion plants operating in the Contracting Party have to comply with the emission limit values for sulphur dioxide (SO2), nitrogen oxides (NOx) and dust individually, which is not the case for nine out of Serbia’s sixteen plants.

Directive 2001/80/EC took effect in the Energy Community on 1 January 2018. The draft NERP of Serbia was approved by the Secretariat in 2016. It has, however, not been adopted ever since.
