The local content clause in the Electricity Law of Ukraine has been criticized in the past by investors, the European Union as well as international financial institutions alike. Under this clause, eligibility for feed-in tariffs for investments in renewable energy depends on the fulfilment of minimum shares of goods and works of Ukrainian origin (local content). Under the WTO Agreement, a similar clause applied by Canada was declared non-compliant in 2013.

Following the adoption of the amendments to the Electricity Law in Ukraine and the removal of the mandatory local content requirement for benefiting from support schemes for electricity produced from renewable energy, the Secretariat decided to close Case ECS-07/13 on 23 July 2015.
